10. Stormwater Management: The Stormwater Management Plan has <br />been approved by the Public Works Department. <br />11. Utilities: Unmanned facilities, such as this one, are not <br />required to be serviced by public water or wastewater services <br />or on site systems. Therefore, county utilities has no <br />objection to approval of the site plan and use request. <br />12. Health & Rehabilitative Services (HRS): The HRS Environmental <br />Health Unit acknowledges that the site will not require a <br />potable water supply or sanitary facility, and has no <br />objections to approval of the site plan and use approval. <br />13. Airport Zoning Ordinance Regulations: <br />The proposed 199' tower would extend into one of the county's <br />"height notification zones." Pursuant to the county's airport <br />zoning ordinance regulations, the applicant has been notified <br />that it must file a notice of proposed construction form with <br />the FAA (Federal Aviation Administration), obtain the FAA's <br />determination and comments on the proposed tower, and obtain <br />either an "airport construction permit" from staff or an <br />"airport obstruction variance" from the Board of Adjustment. <br />At this time, the applicant has documented to staff that the <br />appropriate notification form, along with an obstruction <br />evaluation, have been filed with the FAA. The applicant has <br />acknowledged that upon receipt of the FAA's determination, it <br />will apply for a county "airport construction permit". <br />Pursuant to county LDRs [911.17(4)(a)], the project site plan <br />cannot be released until an "airport construction permit" is <br />issued by county staff. After this permit has been obtained, <br />the proposed tower would be in conformance with the county's <br />airport zoning ordinance regulations. <br />14. Special Exception General Review Criteria: In its review of <br />this application, staff has made the following findings in <br />regard to the general review criteria for special exception <br />uses found in LDR section 971.05(7) and (9): <br />1. Ingress/egress and traffic safety have been adequately <br />addressed in the site's access, parking lot, and building <br />access layout. All county codes relating to these issues <br />are satisfied. <br />2. Off-street parking areas have been adequately provided. <br />3. Screening and buffering have been adequately provided, <br />including landscape plantings which screen the parking <br />area and the base of the tower from 16th Place and 90th <br />Avenue. <br />4. Signs and lighting have been addressed in the site plan <br />review and meet all county requirements. <br />5. Required yards and open space have been accommodated by <br />the proposed design. <br />6. Consistency with the comprehensive plan and LDRs: As <br />described in this report, the proposed use and site plan <br />design are in accordance with the comprehensive plan and <br />LDRs. <br />7. Compatibility with surrounding uses: The project <br />intensity, location, and screening is adequate to ensure <br />compatibility with surrounding uses. <br />Bou 96 P9� U <br />NOVEMBER 7, 1995 33 <br />
