Henderson to James Davis dated 10-5-95, 10/12/95 <br />and 10/13/95 <br />DATE-: October 10, 1995 <br />DESCRIPTION AND CONDITIONS <br />In February, 1995, a site plan was being processed by the City of <br />Vero Beach for a Walgreen's Pharmacy Store to be built on the <br />northwest corner of US1 and 17th Street. As is customary, the City <br />transmitted a copy of the site.plan to the County since the site <br />borders a County road, 17th Street to the south, and a state FDOT <br />road, US 1, to the east. The County staff reviewed the plan to <br />determine compliance with the County Thoroughfare Plan and impact <br />on County and state roadways. The Thoroughfare Plan designates <br />both SR60 and 17th Street as Primary Arterial Routes with 120' of <br />ultimate right-of-way on US1 and 120' - 150' of ultimate right-of- <br />way along 17th Street. The City of Vero Beach and County staffs <br />communicated this information to the developer. The County staff <br />indicated that the needed right-of-way should be determined, and if: <br />the developer would not donate the needed additional right-of-way <br />for future roadway expansion, the County staff would recommend to <br />the Board of County Commissioners and State DOT that the County <br />and/or state should purchase the right-of-way at an agreed upon <br />price. On Feb. 15 and 20, 1995, the County staff letters informed <br />the developer to meet with the Public Works Director to determine <br />needed right-of-way and agree upon compensation so a recommendation <br />could be considered by the Board of County Commissioners. This <br />action was again verbally communicated in a meeting on Feb. 23, <br />1995 at City Hall. <br />In May, 1995, a map was prepared by the developer showing the <br />ultimate right-of-way along 17th Street and USI and the County <br />staff was told that the cost would be over $20 per square foot of <br />close to $1,000,000 per acre. <br />On May 11, 1995, Jim Davis responded to the developer's Engineer, <br />Scott McGuire, that after more detailed review, the County staff <br />felt that the right-of-way needs could be reduced and transmitted <br />a revised right-of-way map. It appears, at that time, that the <br />developer would not agree to reducing the right-of-way and staff <br />received no documentation on the developer's request for <br />compensation. <br />NOVEMBER 7, 1995 <br />43 <br />Bou 556 <br />
