SMITH, CLERK <br />(c) To conduct appropriate firefighting and trainings as required by State and Federal law; <br />(d) To conduct safety inspections at the physical facility of the Airport; and <br />(e) To supervise and direct all activities relating to accidents involving potentially <br />hazardous materials. <br />Whether a use of the Premises meets this Section shall be determined in LESSOR's sole <br />discretion by LESSOR's Airport Director, after consultation with LESSEE's County Administrator. <br />Nothing in this LEASE shall be construed to limit the functions of LESSEE in the event of an <br />imminent threat to health, safety, or welfare, or other emergency. Any additional uses of the Premises <br />not involving ARFF services or other related emergency services must be approved by LESSOR <br />through a signed, written agreement. All uses shall be in compliance with the CITY's comprehensive <br />plan, and all applicable zoning and land use codes and other laws. <br />Section 5.2. Non-interference with Airport. <br />Except where otherwise required in an emergency, LESSEE agrees to refrain from and prevent <br />any use of the Premises or the Airport, which would interfere with, disturb, or adversely affect the <br />operation or maintenance of the Airport, or otherwise constitute an Airport hazard or a nuisance. <br />LESSEE shall make no unlawful, improper, or offensive use of the Premises. <br />Section 5.3. Waste; Surrender of Possession. <br />LESSEE will not commit or permit waste of the Premises and must quit and voluntarily deliver <br />up possession of the Premises at the end of the Term in as good condition as at the beginning of this <br />LEASE, and all fixtures, equipment, and improvements in as good condition as when installed or <br />Page 9 of 41 <br />
