� s � <br />The current zoning classification of the subject property is RS -6, <br />Single -Family Residential District. The Land Use Designation is L- <br />2, allowing up to six (6) units per acre. <br />ALTERNATIVES -AND ANALYSIS: <br />The request has been reviewed by Bell South, Florida Power & Light, <br />the area -serving cable company, the County Utilities Department, <br />the County Engineering and Road & Bridge Divisions, and the County <br />Planning Division. Based on their reviews, it is staff's <br />determination that the release would have no adverse impact to the <br />subject property. Planning staff has determined that -the proposed <br />easement release will not affect Indian River Club's satisfaction <br />of minimum requirements for native upland conservation, since the <br />original easement included more area than the minimum required 15% <br />set-aside. <br />RECOMMENDATION: <br />Staff recommends that the Board, through adoption of the attached <br />resolution, release the referenced 57.6 square foot portion of the <br />dedicated conservation easement (as more particularly described in <br />the resolution). <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously adopted <br />Resolution 95-143 releasing the easement described <br />therein to Indian River Club, Inc. <br />RESOLUTION NO. 95-143 <br />A RESOLUTION OF INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, Indian River County has an easement as described <br />below; and <br />WHEREAS, the retention of a portion of that easement serves no <br />public purposes, <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County <br />Commissioners of Indian River County, Florida that: <br />This release of easement is executed by Indian River County, a <br />political subdivision of the State of Florida, whose mailing <br />address is 1840 25th Street, Vero Beach, Florida 32960, Grantor, to <br />Indian River Club, Inc. c/o Robert B. Swift successors, in <br />interest, heirs and assigns, whose mailing address is 2055 S. U.S. <br />Highway #1, Vero Beach, Florida 32962, Grantee, as follow: Vero <br />Indian River County does hereby abandon all right, title, and <br />interest that it may have in that portion of an ingress and egress <br />easement described as follows: <br />release of a 57.6 square foot portion of a dedicated <br />conservation easement, being more particularly described as <br />follows: beginning at the southwesterly corner of said <br />conservation easement Tract "D", proceed N. 08 degrees 39 <br />minutes 24 seconds W. along the westerly line of said <br />Conservation Tract "D", a distance of 8.62 feet; thence N. 77 <br />degrees 45 minutes 29 seconds E. distance of 6.60 feet; thence <br />S. 08 degrees 39 minutes 24 seconds E. parallel to said <br />westerly line a distance of 8.86 feet to the northerly right <br />BOOK 96 pa"r f I n <br />NOVEMBER 21, 1995 7 <br />
