To use these provisions to approve a development project where <br />existing roadways are not adequate to accommodate the impacts of a <br />project but where a roadway improvement that would accommodate the <br />project's demand is in the county's or FDOT's capital improvement <br />program, the needed roadway must be identified in the capital <br />improvements element with specific start and completion dates. <br />Recognizing that certain roadways are approaching capacity but are <br />programmed for improvements,' staff has prepared Table 13.24. That <br />table lists several roadway improvement projects along with their <br />start and completion dates. In adopting Table 13.24 as an <br />amendment to the capital improvements element, the county will <br />allow development projects that might be denied because of level - <br />of -service deficiencies with the roadways shown in Table 13.24 to <br />be approved based upon the county's commitment to make the required <br />improvements in the referenced timeframes. <br />To implement the proposed changes, the Capital Improvements Element <br />amendment must update the text of the Capital Improvements Element <br />to reflect changes in state law. That update includes new table <br />13.24 which gives the estimated date of commencement of actual <br />construction and the estimated date of project completion for <br />priority transportation projects. <br />The Capital Improvements Element amendment includes new policy 5.13 <br />which specifically adopts table 13.24. The amendment also includes <br />changes to tables 13.8, 13.18 and 13.23 .to maintain the -internal <br />consistency of the element. <br />ANALYSIS <br />Following a discussion of the consistency of the proposed <br />amendments with the comprehensive plan, this section will present <br />an analysis of the reasonableness of each of the proposed <br />amendments. <br />CONSISTENCY WITH THE COMPREHENSIVE PLAN <br />Comprehensive plan amendment requests are reviewed for consistency <br />with all policies of the comprehensive plan. As per section <br />800.07(1) of the county code, the "comprehensive plan may only be <br />amended in such a way as to preserve the internal consistency of <br />the plan pursuant to Section 163.3177(2) F.S." <br />The goals, objectives and policies are the most important parts of <br />the comprehensive plan. Policies are statements in the plan which <br />identify the actions which the county will take in order to direct <br />the community's development. As courses of action committed to by <br />the county, policies provide the basis for all county land <br />development related decisions --including plan amendment decisions. <br />While all comprehensive plan policies are important, some have more <br />applicability than others in reviewing plan amendment requests. Of <br />particular applicability to these proposed amendments are the <br />following policies and objectives. <br />Future Land Use Element Policy 13.3 <br />In evaluating any comprehensive plan amendment request, the most <br />important consideration is Future Land Use Element Policy 13.3. <br />This policy requires that at least one of three criteria be met in <br />order to approve a comprehensive plan amendment. These criteria <br />are: <br />a mistake in the approved plan; <br />an oversight in the approved plan; or <br />a substantial change in circumstances. <br />Based on its analysis, staff believes that the proposed amendments <br />meet the third criterion. <br />- Traffic Circulation Element <br />When the comprehensive plan was adopted, the county did not have an <br />MPO. Since that time, an MPO has been established, and that MPO <br />has adopted a 2020 Long Range Transportation Plan that is based on <br />the latest and best available data. The establishment of an Indian <br />River County MPO, and the development of the MPO's 2020 Long Range <br />Transportation Plan, constitute a substantial change in <br />circumstances. For that reason, the proposed amendment meets <br />Future Land Use Element Policy 13.3's third criterion and is <br />consistent with Future Land Use Element Policy 13.3. <br />NOVEMBER 21, 1995 33 BOOK 96 pA,E 6"6 <br />
