Szpyrka, P.E., P.E., Public Works Director <br />James Ennis, P.E., Assistant Public Works Director <br />FROM: Richard Reichenbach, P.E., Project Engineer <br />SUBJECT: Easement and Agreement for FPL Underground Distribution Facilities for <br />Moorhen Marsh Low Energy Aquatic Plant Systems (LEAPS) Headworks Structure <br />DATE: May 3, 2022 <br />DESCRIPTION AND CONDITIONS <br />On June 8, 2021 Indian River County Commissioners awarded bid number 2021038 to Allen Concrete & <br />Masonry, Inc. in the Amount of $10,987,684.90 for the construction of the Moorhen Marsh Low Energy Aquatic <br />Plant Systems (LEAPS), located at 6250 53rd Street, Vero Beach FL, 32967. The facility is Indian River County's <br />sixth regional pollution control system designed to protect the Indian River Lagoon from excessive nutrient <br />discharges from the Indian River Farms Water Control District's canal system. <br />During coordination with Florida Power & Light (FPL) for securing the site's secondary electrical service for the <br />Moorhen Marsh LEAPS facility pole barn it was determined that it is necessary to install an underground <br />electrical service from the 53rd Street right-of-way to the required location for the electrical service. <br />In order for FPL to install the electric facilities and perform work on county property necessary to provide <br />electrical service, the County must provide FPL with an underground easement, enter into an Underground <br />Distribution Facilities Installment Agreement, and contribute $4,544.99 towards the construction to cover the <br />differential cost between an underground and an overhead system. An FPL credit of $1,106.00 is to be applied <br />to Indian River County for trenching, backfilling, installation of conduit and other work as shown in the FPL <br />exhibits thus resulting in a net payment of $3,438.99. <br />FUNDING <br />Funding is budget and available in: <br />Description <br />Account Number <br />I Amount <br />Optional Sales Tax/Publix Works/Moorhen Marsh -PC North <br />1 31524338-066510-16018 <br />1 $3,438.99 <br />RECOMMENDATION <br />Staff recommends that the Board of County Commissioners approve the Underground Distribution Facilities <br />Installment Agreement, the Underground Easement, and the Notice of FPL Facilities (Form 360) and authorize the <br />Chairman to execute all. <br />LIST OF ATTACHMENTS: <br />1.
