Contract Terms and Conditions <br />222209954,0 <br />v) Arrange for annual Form I-9 audits by an external auditing firm or a trained employee not otherwise <br />involved in the Form I-9 process. <br />vi) Establish a procedure to report to ICE credible information of suspected criminal misconduct in the <br />employment eligibility verification process. <br />vii) Establish a program to assess subcontractors' compliance with employment eligibility verification <br />requirements. Encourage contractors to incorporate the IMAGE Best Practices contained in this paragraph <br />and, when practicable, incorporate the verification requirements in Subcontractor agreements. <br />viii) Establish a protocol for responding to letters received from Federal and State government agencies <br />indicating that there is a discrepancy between the agency's information and the information provided by the <br />employer or employee; for example, "no match" letters received from the Social Security Administration. <br />ix) Establish a tip line mechanism (inbox, e-mail, etc.) for employees to report activity relating to the <br />employment of unauthorized workers, and a protocol for responding to employee tips. <br />x) Establish and maintain appropriate policies, practices, and safeguards against use of the verification <br />process for unlawful discrimination, and to ensure that U.S. citizens and authorized workers do not face <br />discrimination with respect to hiring, firing, recruitment or referral for a fee because of citizenship status or <br />national origin. <br />(xi) Maintain copies of any documents accepted as proof of identity and/or employment authorization for <br />all new hires. <br />5.4. Contractor Use of Hillsborough County For Marketing Prohibited <br />The Contractor shall in no way use any statements, whether written or oral, made by the County's employees to <br />market, sell, promote or highlight the Contractor and/or the Contractor's product(s) and/or service(s) unless <br />authorized to do so, in writing, by the County Administrator or his/her designee. In addition, the Contractor shall not <br />use subjective or perceived interpretations, even if factual, regarding the County's opinion of the Contractor's <br />performance, product(s) and/or service(s) in any document, article, publication or press release designed to market, <br />promote or highlight the Contractor and/or the Contractor's product(s) and/or service(s). This does not prevent the <br />Contractor from including the County on its client lists and/or listing or using the County as a reference. <br />5.5. Contractor's Responsibilities <br />The Contractor will give all notices and comply with all laws, ordinances, rules and regulations applicable to the <br />Work and/or Project. If the Contractor observes that the Specifications are at variance with such laws, ordinances, <br />rules or regulations, then the Contractor will give the County prompt written notice thereof, and any necessary <br />changes shall be adjusted by an appropriate Change Order, Unilateral Change Order or Modification Agreement to <br />the Contract. If the Contractor performs any Work knowing that such Work is contrary to such laws, ordinances, <br />rules and regulations and without giving such notice to the County, the Contractor will bear all costs arising <br />Hillsborough County Board of County Commissioners Page 50 of 61 <br />
