71 <br />PART III—AWARD CONDITIONS <br />■. GENERAL CONDITIONS. <br />The recipient covenants and agrees that it will expeditiously initiate and timely complete the project work for <br />which assistance has been awarded under this agreement, in accordance with all applicable provisions of 40 CFR <br />Chapter 1, Subpart B. The recipient warrants, represents, and agrees that it, and its contractors, subcontractors, <br />employees and representatives, will comply with: (1) all applicable provisions of 401CFR Chapter 1, Subchapter B, <br />INCLUDING BUT NOT LIMITED TO the provisions of Appendix A to 40 CFR Part 30, and (2) any special <br />conditions set forth in this assistance agreement or any assistance amendment pursuant to 40 CFR 30.425. <br />b. SPECIAL CONDITIONS: <br />(For cooperative agreements include identification or summarization of EPA responsibilities that reflect or <br />contribute to substantial involvement.) <br />1. The grantee agrees to submit, immediately after execution, a copy of all contracts (A/E <br />and Construction) associated with this grant. The contract documents are required in <br />order to process grant payments and change orders. <br />2. EPA reimbursement for engineering fees will be limited to 30% of the total eligible <br />engineering fees until the DER approves the contract for engineering services. <br />3. Estimated eligible construction costs were determined to be $1,837,750 or 99.4% of <br />total construction costs of $1,848,350. This factor, applied to.relevant line items of the <br />approved application budget, yields the following: <br />Administration $50,000 x 99.4% = $49,700 <br />Basic engineering 23,100 x 99.4% = 22,961 <br />Other engineering 2,400 x 99.4% = 2,386 <br />Project inspection 50,000 x 99.4% = 49,700 <br />4. One year after the date of initiation of operation of project facilities, the <br />grantee agrees to certify to the following performance standards: <br />Grinder Pumps <br />Capacity ofach Pump(2pm) Rated TD11(f_t) Speed (rpm) <br />d <br />--�— <br />4.5 <br />Pressure Sewer Force Mains and Service Connections <br />Exfiltration <br />0.00135 gph/inch-dia/pipe joint at 100 psi <br />Note: The project's ability to meet performance standards is to be evaluated using <br />field measurements obtained under operating conditions. <br />5. The grantee agrees to submit at least one interim progress report summarizing the <br />results of data collected, observations made and resources expended during that portion of <br />the twelve-month operational period prior to performance certification. The final report <br />shall summarize the remaining portion of the operational period prior to certification. <br />6.
