40 <br />APPENDIX E <br />The Issuer. Polk County Industrial Development Authority is a public <br />body corporate and politic and a public instrumentality of the State of <br />Florida. The issuer is authorized by the Enabling Legislation to issue the <br />Polk County Industrial Development Authority Bonds and lend the proceeds <br />thereof to the Company for the purpose of refinancing the Polk County Project. <br />E-3 <br />
