Uf <br />ma 96 pAn 774 <br />DESCRIPTION & CONDITIONS: <br />Sea Oaks River Villas Phase II is a boundary plat of a 2.45 acre <br />parcel located adjacent to Jungle Trail in the western section of <br />the Sea Oaks PRD project (see attachment #2). The final plat will <br />create private, internal road right-of-way area and one 2.45 acre <br />parcel that will contain 3 condominium buildings, totaling 18 <br />units. Final plat approval is required before any of the 3 <br />buildings can be issued a certificate of occupancy (C.O.). <br />On February 2, 1989, the Planning & Zoning Commission granted <br />preliminary PRD plan/plat approval for Sea Oaks River Villas. A <br />land development permit was subsequently issued for infrastructure <br />improvements. Infrastructure improvements were commenced but not <br />completed when a new developer acquired the overall Sea Oaks <br />project. The new developer requested and received approval to <br />modify the preliminary PRD plat and plans on December 8, 1994, and <br />has now completed the infrastructure improvements. The new <br />developer is now requesting final plat approval, and has submitted <br />the following: <br />1) A certificate of completion for all infrastructure <br />improvements <br />2) A final plat in conformance with the approved, <br />modified preliminary PRD plat and plans.* <br />ANALYSIS: <br />All required improvements necessary to provide access and services <br />to the overall phase II tract have been constructed, and a <br />certificate of completion has been issued by the Public Works <br />Department. Required improvements necessary to serve individual <br />buildings within the tract, as well as a required Jungle Trail <br />buffer, are controlled via the PRD site plan and will be provided <br />on a building -by -building basis. Prior to obtaining a Certificate <br />of Occupancy (C.O.) for any building, the required improvements and <br />buffer necessary to serve the building will be constructed by the <br />developer. All of the required improvements in the development <br />will be private, except utilities, which will be dedicated and <br />warranted separately. Since the provision of required internal <br />improvements for individual buildings will be controlled through <br />the PD site plan process, and since the required improvements <br />necessary to provide service to the overall phase It tract have <br />been constructed, the developer has satisfied all requirements for <br />final plat approval. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners grant final <br />plat approval for Sea Cans River Villas Phase II PRD. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously granted <br />final plat approval for Sea Oaks River Villas Phase <br />II PRD, as recommended in the memorandum. <br />E.
