Heath <br />Code Enforcement Officer <br />DATE: December 12, 1995 <br />SUBJECT: Request for Board Approval of Release of Easements <br />in Rosewood Court Subdivision <br />It is requested that the data herein presented be given formal consideration by <br />the Board of County Commissioners at its regular meeting of December 19, 1995. <br />DESCRIPTION AND CONDITIONS: <br />The County has been petitioned by the Rosewood Development Corporation, owners <br />of the subject property, for the release of multiple drainage and utility <br />easements, and one limited access easement, in Rosewood Court Subdivision. It <br />is the petitioner's contention that these easements are beyond the minimum <br />required, and unnecessarily impede landscape and accessory structure development <br />on platted lots within the private subdivision. <br />The current zoning classification of the subject property is RS -2, Single -Family <br />Residential District. The Land Use Designation is L-1, allowing up to 3 units <br />per acre. <br />ANALYSIS: <br />The request has been reviewed by Bell South Telephone Company; Vero Beach <br />Utilities; T.C.I. Cablevision Corporation; County Utilities; and the County Road <br />& Bridge and Engineering Divisions. Based upon their reviews, it is staff's <br />position that release of these easements would have no adverse impact on <br />utilities and drainage associated with the subdivision. Particularly, county <br />engineering staff has closely reviewed the proposal to ensure that adequate <br />drainage easements remain within the subdivision. <br />REC01IIMEPDATION: <br />Staff recommends to the Board, through the adoption of the attached resolution, <br />release easements in Rosewood Court Subdivision as more particularly described <br />in said resolution. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Adams, the Board unanimously adopted <br />Resolution No. 95-156 abandoning certain easements <br />in Rosewood Court Subdivision as described therein. <br />5 <br />December 19, 1995 BOOK 6 ���i'� 775 <br />
