Finney, SRA % <br />County Right -of -Way Agent <br />SUBJECT: 58th Avenue Right -of -Way Acquisition; <br />of 26th Street and 58th Avenue <br />DATE: December 11, 1995 <br />DESCRIPTION AND CONDITIONS <br />pvu 854 <br />Southeast corner <br />An additional 35 feet of right-of-way is required on the east side <br />of 58th Avenue for the four lane paving improvement project from SR <br />60 to 33rd Street. <br />The property owner has executed a contract with Addendum to donate <br />the right-of-way to the county in exchange for the conditions in <br />the Addendum. <br />The terms of the contract and addendum provide the county <br />constructing a median opening for southbound 58th Avenue ingress to <br />the seller's property, with no southbound egress, and <br />ingress/egress access on 26th Street. Buyers. to provide a sidewalk <br />on 58th Avenue and adjacent to 26th Street or, in"lieu of sidewalk <br />on 26th Street, reimburse the Seller $1,000. <br />Completion of the project is to be accomplished by January 1, 2000 <br />or the property reverts to the Seller. Seller will have transfer <br />of density credit for the 1.032 acres conveyed to the County. <br />Buyer shall pay cost of recording fees. Sellers to pay their own <br />attorneys fees.
