Division 1— General Requirements, IRC -1707 <br />d. Name and address of similar projects on which product was used, and date <br />of installation. <br />2. For construction methods (if specified): <br />a. Detailed description of proposed method. <br />b. Drawings illustrating method. <br />3. Such other data as the ENGINEER may require to establish that the proposed <br />substitution is equal to the product, manufacturer or method specified. <br />C. In making Request for Substitution, CONTRACTOR represents that: <br />1. CONTRACTOR has investigated proposed substitution, and determined that it is <br />equal to or superior in all respects to the product, manufacturer or method <br />specified. <br />2. CONTRACTOR will provide the same or better guarantees or warranties for <br />proposed substitution as for product, manufacturer, or method specified. <br />3. CONTRACTOR waives all claims for additional costs or extension of time related <br />to a proposed substitution that subsequently may become apparent. <br />D. A proposed substitution will not be accepted if: <br />1. Acceptance will require changes in the design concept or a substantial revision <br />of the Contract Documents. <br />2. It will delay completion of the Work, or the work of other contractors. <br />3. It is indicated or implied on a Shop Drawing and is not accompanied by a formal <br />Request for Substitution from CONTRACTOR. <br />E. If the ENGINEER determines that a proposed substitute is not equal to that specified, <br />furnish the product, manufacturer, or method specified at no additional cost to OWNER. <br />F. Approval of a substitution will not relieve CONTRACTOR from the requirement for <br />submission of Shop Drawings as set forth in the Contract Documents. <br />G. The procedure for review by Engineer will include the following: <br />1. Requests for review of substitute items of material and equipment will not be <br />accepted by Engineer from anyone other than CONTRACTOR. <br />2. Upon receipt of an application for review of a substitution, Engineer will <br />determine whether the review will be more extensive than a normal shop <br />drawing review for the specified item. <br />3. If the substitution will not require a more extensive review, Engineer will proceed <br />with the review without additional cost to CONTRACTOR. <br />4. If the substitution requires a more extensive review, Engineer will proceed with <br />the review only after CONTRACTOR has agreed to reimburse Owner for the <br />review cost. <br />5.
