BOOK 97 Pnu 85 <br />way into the District's canal. 4th Street is owned by the <br />District and this particular case relates to all the other permits <br />that have been necessary in getting clearance along other roads in <br />the District. This one may .be preconceived as an arm -twisting <br />deal, but the District thought that the clearing was part of the <br />original permit deal. <br />Commissioner Bird asked how long it would be before the <br />expansion of 4th Street would necessitate clearing the ditch on the <br />other side. Perhaps it would be better to clear it all at one <br />time. <br />Community Development Director Bob Keating advised that 4th <br />Street was not in the long range plan of the Metropolitan Planning <br />Organization (MPO). <br />Commissioner Bird wanted to maintain a cooperative <br />relationship with the District, but he felt that the clearing could <br />be done in conjunction with the road widening project and then <br />allocate the cost properly. <br />Director Pinto explained that the facilities have been <br />constructed; we are ready to move the contractor out. The County <br />could enter into an agreement whereby they commit to clearing the <br />rights-of-way when the time comes. <br />Mr. Carter advised that the District is meeting this Thursday <br />to discuss this issue. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Bird, the Board unanimously approved <br />Change Order #3B; denied approval of Change. Order <br />#3A; directed staff to revisit the permit issue with <br />IRFWCD and agree to do the clearing in the future in <br />conjunction with the 4th Street expansion. <br />Commissioner Tippin philosophically observed that these change <br />orders involving additional costs of $300,000, or 5.5% of the <br />initial contract, are being viewed as "a very acceptable" amount. <br />Commissioner Tippin didn't consider that a "very acceptable" <br />amount. He suggested that verbiage be changed in the future.
