costs, and other costs directly or indirectly attributable to such violation as <br />determined by the P.E.R.C., Circuit or District Court, in determining the <br />amount of damages to be awarded, if any, the Commission or trier of fact <br />shall take into consideration any action or inaction by the public employer <br />that provoked or tended to provoke the strike by the public employees. <br />11.04 It is further agreed that the providing of fire protection services by the Employer is <br />extremely vital to the health, welfare, and safety of the citizens of the District and any <br />interference with such services is in violation of this article and would constitute a threat <br />of imminent danger to said citizens and possible irreparable harm. The parties agree that <br />should the Union, its members, persons acting in the Union's behalf, agents, employees, <br />representatives, or officers acting in the Union's behalf violate this article not to strike, <br />which would also violate the Constitution of the State of Florida and the Florida Statutes, <br />or picket in furtherance of a work stoppage or violate this clause in any other manner, and <br />said action would cause the District irreparable injury or damage, and the Employer shall <br />have the right to seek injunctive relief pursuant to Chapter 447, Florida Statutes. <br />11.05 Employees who refuse to perform the regular duties of their job because of strike, boycott, <br />or picket line in furtherance of any work stoppage, upon the Employer's premises, or at any <br />other place, shall be in violation of this article and subject to layoff or discharge at the <br />discretion of the Employer. Such action shall be a violation of this article, regardless of <br />which labor organization is conducting the strike, work stoppage, picketing or labor <br />dispute. <br />15 <br />
