Bm 97 ph -GE 213 <br />WHEREAS, the acquisition of the small parcels can be handled more <br />expeditiously by authorizing the County Administrator to complete the <br />purchase, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. AMENDMENT. <br />Section 105.01 is amended by the underlined addition to read as <br />follows: <br />Section 105.01. Authority of county administrator. <br />Except as otherwise provided by Florida Statutes, the county <br />administrator or his designee is granted authority to purchase <br />or contract for supplies, materials, equipment, real property, <br />or services (other than services under section 287.055, F.S.) <br />costing five thousand dollars ($5,000.00) or less for the <br />county after taking such action as the county administrator <br />shall deem necessary to obtain the best price for the county. <br />Any such purchase or contract may be executed by the <br />county administrator in the name of the county without <br />commission action, although copies of any such contracts shall <br />be available to the commission for inspection. In an <br />emergency, contracts for purchase of parts or repairs to <br />then -existing county equipment or machinery may be <br />purchased or contracted by the county administrator in his <br />capacity as the county administrator, provided the county <br />administrator certifies that a true emergency exists, and <br />routes a copy of the contract to the commission for its <br />inspection with a memorandum describing the emergency <br />situation. <br />SECTION 2. SEVERABILITY. <br />If any section, or any sentence, paragraph, phrase, or word of <br />this ordinance is for any reason held to be unconstitutional, <br />inoperative, or void, such holding shall not affect the remaining <br />portions of this ordinance, and it shall be construed to have been the <br />legislative intent to pass the ordinance without such unconstitutional, <br />invalid or inoperative part. <br />SECTION 3. <br />EFFECTIVE DATE. <br />A certified copy of this ordinance, as enacted, shall be filed by <br />the Clerk with the Office of the Secretary of State of the State of <br />Florida within ten days after enactment, and this ordinance shall take <br />effect upon filing with the Secretary of State. <br />Words indicated asare deletions <br />from existing law; words indicated as underlined are additions. <br />42 <br />FEBRUARY 6, 1996 <br />M M <br />M <br />
