RESOLUTION NO, 77 -33 <br />WHEREAS, the United States Congress enacted the Coastal Zone <br />s <br />Management Act of 1972; and <br />® WHEREAS, the Congress found that the key to more effective protection <br />and use of the land and water resources of the coastal zone is to encourage <br />a <br />the states to exercise their full authority over the lands and waters in <br />the coastal zones by assisting the states, in cooperation with federal <br />and local governments and other vitally affected interests, in developing <br />land and water use programs for the coastal zone, including unified <br />policies, criteria, standards, methods, and processes for dealing with <br />land and water use decisions of more than local significance; and <br />WHEREAS, the Florida Department of Environmental Regulation has been <br />recommended by the Governor's Task Force on Development of a State <br />Organizational Structure .for Coastal Zone Management to be the new <br />controlling (Section 306) agency of the State of Florida's Coastal Zone <br />Management Program; and <br />WHEREAS, the Florida Department of Natural Resources, as the State <br />of Florida's present controlling (Section 305) agency of the Coastal <br />Zone Management Program, has displayed a history of responsive co- <br />operation with local and regional agencies, particularly with technical <br />and financial assistance; and <br />WHEREAS, the Florida Department of Environmental Regulation has <br />developed a recent trend toward a centralized departmental policy-making <br />process, decreasing its recognition and utilization of the local and <br />regional agencies' expertise; and <br />WHEREAS, if the Florida Department of Environmental Regulation <br />were assigned the responsibility of the Coastal Zone Management <br />Program, the Department would have both regulatory and certification <br />power, negating balances necessary for responsive control; and <br />WHEREAS, The Congress finds and declares, through paragraph b. <br />of the Declaration of Policy of the Coastal Zone Management Act of 1972, <br />that it is the national policy to encourage and assist the states to <br />exercise effectively their responsibilities in the coastal zone through <br />
