RESOLUTION 77- 114 <br />WHEREAS, The Board of County Commissioners of Indian River <br />County, Florida, and the Clerk of the Circuit Court of Indian <br />River County, Florida, desire to enter into an Agreement as <br />provided by Florida Statute 145.022 (1975); and <br />WHEREAS, an interpretation of Chapter 145 has been made by <br />the Attorney General, State of Florida (AGO 161-151 dated September <br />25, 1961); and <br />WHEREAS, the Clerk will turn over to the Board of County <br />Commissioners without exception all fees and commissions earned <br />in offices under her jurisdiction; and <br />WHEREAS, the Board will in turn cict u1x7n a Clerk's budget <br />establishing all reasonable and necessary expenses to he incurred <br />by the Clerk in the operation of offices under her jurisdiction, <br />including the Clerk's salary as provided in Chapter 145, Florida <br />Statutes; and <br />WHEREAS, the Board shall distribute to the Clerk approved <br />budgeted funds in such monthly installments as shall be mutually <br />satisfactory to the parties. <br />WHEREAS, the Clerk agrees to supply any and all information <br />requested by the Board in the form requested by the Board, including <br />all budgetary information and periodic reports as may be requested, <br />and <br />4111EREAS, all prior resolutions and agreements between the <br />Clerk and the Board of County Commissioners based on Florida <br />Statute 145.022 shall be deemed to be superseded by this Resolution; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS and the CLERK OF THE CIRCUIT COURT OF INDIAN RIVER <br />COUNTY, FLORIDA, That: <br />1. All prior Resolutions between the Clerk and the <br />Board involving Florida Statute 145.022 are superseded by this <br />Resolution. <br />
