BGUX 9 7 PAGE 3? <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Bird, the Board unanimously adopted <br />Resolution 96-26, authorizing the County <br />Administrator to execute certain water and sewer <br />impact fee documents on behalf of the Board. <br />RESOLUTION NO. 96- 26 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, AUTHORIZING THE COUNTY <br />ADMINISTRATOR TO EXECUTE CERTAIN WATER AND SEWER IMPACT <br />FEE DOCUMENTS ON BEHALF OF THE BOARD. <br />WHEREAS, the County provides its utilities customers with financing to <br />pay for water and sewer impact fees and has prepared an agreement and note <br />which is executed by the customer and the County and then recorded; and <br />WHEREAS, this is an on-going, time-consuming, daily process; and <br />WHEREAS, occasionally the utilities customer obtains new financing or <br />refinances the existing first mortgage and the County is requested to execute <br />a subordination; and <br />WHEREAS, after the customer repays the utilities debt, the County <br />executes a satisfaction and records it on the public records; and <br />WHEREAS, it would be beneficial to streamline this process by having the <br />Board authorize the County Administrator, or his designee, to sign these <br />impact fee extension agreements, subordinations, and satisfactions on behalf <br />of the Board; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, that the Board hereby authorizes the County <br />Administrator, or his designee, to sign all agreements, subordinations, and <br />satisfactions for the extended payment of water and sewer impact fees <br />provided that the forms contain the signatures of the County Attorney and a <br />representative of the Utility Services Department. <br />The resolution was moved for adoption by Commissioner Eqqert <br />and the motion was seconded by Commissioner Bird and, upon being put <br />to a vote, the vote was as follows: <br />Chairman Fran B. Adams Aye <br />Vice Chairman Carolyn K. Eggert Aye <br />Commissioner Richard N. Bird Aye <br />Commissioner Kenneth R. Macht Aye <br />Commissioner John W.
