acceptable to the Public Works and Emergency Management <br />departments. Prior to issuance of an LDP (land development <br />permit)'or LDP waiver, public works and emergency services <br />must approve the final design of the emergency access <br />improvement. The traffic engineer has reviewed and approved <br />the on-site traffic circulation plan. <br />12. Stormwater Management: The public works department has <br />reviewed and approved the stormwater management plan. The <br />applicant must obtain a Type "B" stormwater management permit <br />prior to site plan release. Prior to obtaining an LDP, the <br />applicant must obtain a cut and fill waiver for filling within <br />the floodplain, which is a requirement for obtaining the Type <br />"B" stormwater management permit. Staff anticipates that such <br />a waiver, which must be granted by the Board of County <br />Commissioners, will be granted for this project. In addition, <br />the Type "B" permit will require that all structures within <br />the flood plain be set J' above the FEMA minimum elevation for <br />the site. <br />13. Concurrency: Long -Range Planning staff has indicated that a <br />conditional concurrency certificate will be issued for the <br />project prior to the Planning and Zoning Commission's <br />consideration of this item. Thus, all concurrency <br />requirements related to preliminary PD plan approval have been <br />satisfied. <br />14. Dedications & Improvements: Indian River Boulevard, 6th <br />Avenue and 8th Street are all on the county's Thoroughfare <br />Plan map. Both 6th Avenue and 8th Street are classified *as <br />collector roads which require 80' of right-of-way. Presently, <br />80' of right-of-way exists for each street; therefore, no <br />additional right-of-way is required for 6th Avenue or 8th <br />Street. <br />Indian River Boulevard is classified as an arterial road for <br />which the Public Works Director indicates 200' of right-of-way <br />is required. Presently, there is 150' of right-of-way that <br />exists for Indian River Boulevard. For that reason, an <br />additional 25' of right-of-way will need to come from this <br />site to make-up its share of -the 2001. The applicant has <br />agreed to dedicate 25' of Indian River Boulevard right-of-way <br />along the site's eastern boundary. The compensation for this <br />dedication is density credit for the right-of-way area. This <br />density credit is included in the previously described density <br />figures and is allowed pursuant to LDR section 952.08(1)(e). <br />Note: As required under section 952.08(1)(e),- all site <br />coverage requirements and open space requirements, as <br />previously described in this report, are based on the net <br />parcel size (gross parcel area minus the right-of-way <br />dedication area). All setbacks are based on the net parcel <br />area boundary. The density, however, is based on the gross <br />parcel size, since the applicant is dedicating the right-of- <br />way for density credit. <br />Sidewalks are required along the project's 8th Street and 6th <br />Avenue frontages. The applicant has depicted these sidewalks <br />on the plans and will construct the sidewalks within a <br />pedestrian easement which will be dedicated to the county. <br />These improvements must be constructed prior to issuance of a <br />certificate of occupancy (C.O.) for the project. <br />15.
