4. Prior to the issuance of a C.O., the applicant shall construct <br />a 6' wood fence or equivalent along the project's north <br />property line between the project and the Village Walk and <br />Waverly Place developments. <br />5. • That in return for the housing density bonus granted, the <br />project shall be allowed a maximum of 200 residential units at <br />project build -out. In addition, the following affordable <br />housing conditions shall apply: <br />a. Prior to the issuance of a land development permit or <br />land development permit waiver for the project, the <br />applicant shall submit to the county a letter from a <br />state or federal agency verifying that the project is <br />committed to a state or federal housing program which <br />satisfies the county's affordable housing requirements <br />for rental units as found in LDR section 911.14(4), and <br />that a state or federal agency will monitor project <br />compliance with affordable housing requirements. <br />b. That prior to issuance of a C.O. for any affordable <br />housing rental units, the developer shall comply with the <br />deed covenant requirements of LDR section <br />911.14(4)(a)2.f. <br />Planning Director Stan Boling presented staff Is recommendation <br />for approval subject to the five conditions set out in the above <br />memo. <br />Chairman Adams opened the Public Hearing and asked if anyone <br />wished to be heard in this matter. <br />Bruce Barkett, attorney representing the applicant, advised <br />that all the suggestions that staff has made are acceptable. He <br />noted that the project engineer and project manager are here today. <br />to answer any questions the Board may have.
