That, under the standards in Section 380.06 (7) <br />(g), Florida Statutes, the proposed change in <br />route does not constitute a substantial <br />deviation from the original development order. <br />BE IT FURTHER RESOLVED by said Board of County <br />Commissioners that, as to the MODIVIED DEVELOPMENT ORDER: <br />A. The request for modification of the route is <br />hereby approved, subject to the following <br />conditions, definitions, restrictions and <br />limitations: <br />1. The alignment of the corridor in Indian <br />River County shall be as shown on the <br />map attached to this Resolution as <br />Exhibit "A". <br />2. The crossing into Indian River County from <br />St. Lucie County shall be engineered and <br />located substantially in the form as <br />schematically shown by the preliminary <br />sketch attached to this Resolution as <br />Exhibit "B". Any major modification of <br />the crossing into Indian River County as <br />described in Exhibit "B" shall be con- <br />stituted a substantial deviation from the <br />Development Order, subject to additional <br />review as provided in 2.B of this Resolution. <br />3. Except for the change in alignment approved <br />in the preceding paragraph, the develop- <br />ment order contained in Resolution No. 79-26 <br />shall remain in full force and effect. <br />B. A finding by the Board of County Commissioners <br />of Indian River County, Florida, in accordance <br />with Section 380.06 (7), Florida Statutes, after <br />notice and public hearing, that FPL has substan- <br />tially deviated from the conditions, restrictions, <br />and limitations of this Modified Development Order <br />shall result in termination of all development <br />activity under this Development Order and additional <br />regional review pursuant to Section 380.06, Florida <br />Statutes, and other applicable laws of the State <br />of Florida. <br />C. The County Attorney is hereby authorized and <br />directed to cause a certified copy hereof to be <br />served upon the Florida Division of Local Resource <br />- 2 - <br />
