He stated the Attorney General's office produces the Sunshine Law <br />Manual every year which is available free online at the Attorney General's website. <br />Chairman Earman sought and received clarification of a public record request when <br />the item was requested by someone outside of the organization or when it was <br />created by the organization. Attorney Reingold clarified that public records law was a <br />two-way issue. If it was made or received by the governmental entity, it was a public <br />record. <br />No Action Taken or Required <br />13.0 22-1035 Resolution for Adoption of Administrative Fee for Extensions/Modifications to <br />Contracts for Required Roadway Improvements Under Section 312.11 Section <br />312.11 (Performance Security) of the Indian River Code of Ordinances <br />Recommended Action: County staff recommends that the Board approve the draft Resolution setting the <br />administrative fee in the amount of $660 for contract extensions/modification for <br />required roadway improvements. <br />Attachments: Staff Report <br />Proposed Resolution for Extension of Contracts <br />Resolution 2005-041 <br />Resolution 2019-089 <br />Assistant County Attorney Susan Prado stated in the interest of consistency across all <br />processes, staff had proposed a change to Section 312.11 (Performance Security) of <br />Chapter 312 (Rights of Way) of the Indian River Code of Ordinances (the Code). <br />She stated the proposed change would allow for the same administration fee of $660 <br />for contract extensions and/or modifications for required subdivision improvements to <br />be applied to contract extensions and/or modifications for required roadway <br />improvements. Pursuant to Resolution 2019-89, the County Administrator or his/her <br />designee was delegated authority to execute extensions to the standard Contracts for <br />the Construction of Required Roadway Improvements. <br />A motion was made by Vice Chairman Adams, seconded by Commissioner <br />Flescher, to approve staff's recommendation and Resolution 2022-098, setting <br />administration fees for extensions of required improvements and accompanying <br />cash deposit escrow agreements, if applicable. The motion carried by the <br />following vote: <br />Aye: 5 - Chairman Earman, Vice Chairman Adams, Commissioner Flescher, Commissioner <br />Loar, and Commissioner Moss <br />13.D 22-1041 Designated Receiving System Transportation Plan <br />Recommended Action: The County Attorney's Office recommends that the Chair allow for public comment <br />on this matter and then have the Board vote to approve the 2022 Indian River County <br />Indian River County Florida Page 18 <br />
