Bm 9 7 Ft ,c 53-5 <br />for maintenance of the wetlands for 120 days from the substantial <br />completion date. However, recently seasonal migratory birds have <br />taken refuge in the wetlands that resulted in trampled or pulled <br />plants. The contractor replanted these cells; however, the same <br />situation reoccurred. The contractor has asked for an extension in <br />time for replanting the cells until the birds migrate in March. <br />ANALYSIS <br />Per the construction agreement with the County (Section 1.8.5) , 10% <br />retainage ($178,585.00) is withheld from the contractor pending <br />completion of the contract agreement. The engineer, Masteller.and <br />Moler, Inc., 'has determined and recommended in a letter dated <br />February 27, 1996, that the reduction of retainage be reduced to 5% <br />($89,293.00). This determination was based upon their observation <br />that the contractor has worked hard, diligently pursued completion <br />of the job, and cooperated with the County. The retainage was <br />determined by the engineer as sufficient to complete the job. <br />RECOMMENDATION <br />The staff of the Department of Utility Services recommends approval <br />from the Board of County Commissioners for the proposed reduction <br />in -the amount of retainage to 5% ($89,293.00). <br />Chairman Adams asked if this is an addition to the continued <br />services contract the Board approved a couple of weeks ago. <br />Capital Projects Engineer Bill McCain understood that contract <br />would pick up after this 120 -day period.
