To take advantage of the more flexible state concurrency law, the <br />county must amend the concurrency management plan component of its <br />capital improvements element. The principal changes involve <br />modifying the timeframe for commencing construction of a needed <br />roadway facility to be constructed pursuant to a binding contract <br />or a developer's agreement. The proposed amendment would change <br />that.timeframe from one year after development order approval to <br />two years after issuance of a certificate of .occupancy for the <br />project. ---=In addition, the provision to allow issuance of - <br />the community's development. As courses of action committed to by <br />the county, policies provide the basis for all county land <br />development related decisions --including plan amendment decisions. <br />While all comprehensive plan policies are important, some have more <br />applicability than others in reviewing plan amendment requests. Of <br />particular applicability to these proposed amendments are the <br />following policies and objectives. <br />Future Land Use Element Policy 13.3 <br />In evaluating any comprehensive plan amendment request, the most <br />important consideration is Future Land Use Element Policy 13.3. <br />This policy requires that at least one of three criteria be met in <br />order to approve a comprehensive plan amendment. These criteria <br />are: <br />• a mistake in the approved plan; <br />• an oversight in the approved plan; or <br />• a substantial change in circumstances. <br />Based on its analysis, staff believes that the proposed amendments <br />meet the third criterion. <br />- Traffic Circulation Element <br />When the comprehensive plan was adopted, the county did not have an <br />MPO. Since that time, an MPO has been established, and that MPO <br />has adopted a 2020 Long Range Transportation Plan that Is based on <br />the latest and best available data. The establishment of an Indian <br />River County MPO, and the development of the MPO's 2020 Long Range <br />Transportation Plan, constitute a substantial change in <br />circumstances.' For that reason, the proposed amendment meets <br />Future Land Use Element Policy 13.3's third criterion and is <br />consistent with Future Land Use Element Policy 13.3. <br />The third criterion of Future Land Use Element Policy 13.3 also <br />applies to the changes to Figures 4.5.2 and 4.13.2. These changes <br />update the functional classification from Rural Principal Arterial <br />to Urban Principal Arterial for S.R. 60 between I-95 and 100th <br />Avenue. <br />After the 1990 Census, the boundary of the county's urbanized area <br />expanded west along S.R. 60 from I-95 to 100th Avenue. The <br />expansion of the urbanized area constitutes a substantial change in <br />circ.iaLw Lances . ror that reason, the proposed amendment waists <br />Future Land Use Element Policy 13.3's third criterion and is <br />consistent with Future Land Use Element Policy 13.3. <br />- Capital Improvements Element <br />State law determines the conditions under which programmed <br />improvements to a roadway may be considered when assessing the <br />roadway's capacity. Since plan adoption, state law regarding this <br />issue has been changed. That revision to state law constitutes a <br />substantial change in circumstances.
