He delineated many other frustrations his parents <br />have encountered and suggested several reasons supporting the need <br />for Storm Grove Road. <br />Commissioner Bird asked if the situation would be satisfied if <br />the Board decided to construct Storm Grove Road between US #1 and <br />Old Dixie. <br />Mr. O'Neill advised that his parents said they would love <br />that. <br />Commissioner Bird indicated he saw no problem constructing <br />that interconnecting road whether it goes further west or not. He <br />asked Director Davis what it would take to get it on a plan. <br />Director Davis advised that it would take a motion through the <br />MPO or perhaps it could be budgeted at budget time through Road and <br />Bridge. He estimated that the cost for that 200 feet would be <br />$10,000. <br />Commissioner Macht suggested they could do that and <br />Commissioner Bird asked that it be included as a budget item this <br />summer for discussion at that time. <br />Attorney McKinnon had two comments, the first concerning the <br />preliminary site plan approval or lack thereof. He recalled there <br />were 3 or 4 pages of items that staff wanted Vero Sand Pines to <br />address, not just the access issue. Second, while he was sorry to <br />hear of the O'Neill's problem for the last 20 years, the contract <br />was not executed until 1985 and it requires the Board to annually <br />determine the County's need. He reminded them that they need to <br />address the County's need today. <br />Commissioner Bird asked who would get the use of the $81,000 <br />security if the Board follows staff's recommendation (Alternative <br />3). <br />Attorney McKinnon felt Hawk's Nest had no contractual <br />obligations until such time as the County has determined a need for <br />Storm Grove Road. <br />Commissioner Eggert wondered if the Board could consider <br />recognizing that there is a developer's need, but not, in the <br />truest sense, a County need. <br />Commissioner Bird believed that if the Board were to do that, <br />then the wording in Alternative 3 that assigns the Developer's <br />Agreement to Vero Sand Pines would have to be removed. <br />Commissioner Macht thought that would not be possible. <br />50 <br />April 9, 1996 <br />
