337359 <br />RESOLUTION NO. 83- 6 <br />A RESOLUTION OF THE BOARD OF COUNT}: COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, VACATING AND <br />ANNULLING THE PLAT OF RAVINIA GARDENS SUBDIVISION, <br />PLAT BOOK 1 PAGE 56, OF THE PUBLIC RECORDS OF <br />INDIAN RIVER COUNTY, FLORIDA. <br />WHEREAS, §177.101 of Florida Statutes authorizes the <br />Board of County Commissioners to adopt resolutions vacating sub- <br />diviainn nits In .hole or in past, reiurning the property con- <br />tained therein to acreage and vacating all streets and easements <br />which have not become necessary for the public's use; and <br />WHEREAS, the County has received an application from <br />Laurel Builders, Inc., requesting that it vacate the plat pre- <br />sently of record for the subdivision known as Ravinia Gardens, <br />approved February 15, 1926, and recorded in Plat Book 1 Page 66 of <br />the Public Records of Indian River County, Florida, which plat is <br />a subdivision of the west 10 acres of the east 20 acres of Tract <br />5, Section 10, Township 33 South, Rangy 39 East, as designated on <br />the last general plat of the lands of the Indian River Farms <br />Company, filed in the Office of the Clerk of the Circuit Court of <br />St. Lucie County, Florida, said land now lying in Indian River <br />County, Florida; and <br />WHEREAS, the applicant has shown that it is the fee <br />simple owner of all that property described by said plat with the <br />exception of those streets dedicated therein to the public; and, <br />that said streets have never been constructed or opened for use by <br />the traveling public; and, that vacation of this plat will not <br />affect the ownership or right of convenient access of persons own- <br />ing other parts of this subdivision, as there are none; and <br />WHEREAS, the applicant has presented certification that <br />all currently due state and local taxes affecting said property <br />have been paid; and <br />WHEREAS, applicant has published proper legal notice of <br />its application to the County for this vacation and annulment, in <br />accordance with Florida Statutes §177.101 (4); and <br />WHEREAS, it is the intent of. the Board of County <br />1�1 <br />Commissioners that once adopted and duly recorded in the Office of <br />J <br />v the Clerk of the Circuit Court, this resolution shall have the <br />-1- <br />R <br />
