f <br />pointed out that there was already damage on the road in front of <br />Mr. Seeley's house, which Mr. Seeley said he would repair. That <br />has not been done. <br />Mrs. Seeley claimed the damage was caused by dump trucks <br />bringing in 90 loads of fill during the construction of their <br />house. <br />Commissioner Macht called for a strict application of the law <br />via code enforcement. <br />County Attorney Vitunac indicated he saw one violation in the <br />photographs and that Messrs. Keating and DeBlois are responsible <br />for code enforcement. Any evidence should be brought to them. <br />County Attorney Vitunac asked Director Keating if it was his <br />intention, when the exception was written, that tow trucks would be <br />there 24 hours a day, 7 days a week. <br />Director Keating advised that was not specifically addressed <br />when the exception was written. He felt more research would have <br />to be done such as talk again with the Sheriff to see what the <br />needs are. That is a possibility for changing the ordinance. It <br />could be made allowable to have the tow trucks there in the <br />evenings, weekends, holidays, etc. Right now, he does consider it <br />a violation for bringing wrecks into the neighborhood. That is <br />enforceable. The big question is, does the Board want the tow <br />trucks in neighborhoods. The Code Enforcement Board and staff had <br />approached it as a trade off for quick response. <br />Commissioner Eggert stated it had never occurred to her that <br />the ordinance allowing tow trucks to park in residential <br />neighborhoods was to be anything but at night, or Sundays and <br />holidays. <br />Chairman Adams remarked that the perception is that a business <br />is being run from the house or the vehicle, a perception that is <br />not wanted. She further stated that the intent is to reach a happy <br />medium. <br />Mrs. Seeley interjected that the business operates 24 hours a <br />day, not just at night, through the use of her husband's cellular <br />phone. <br />Commissioner Bird agreed with Commissioner Eggert as he had <br />envisioned it differently when he voted for it. He did not realize <br />it would impact the neighborhood so frequently and so negatively. <br />He thought the rotation came up less frequently than every night. <br />Mrs. Seeley reiterated they are on 4 rotation lists and the <br />customer has the option to choose which tow company they want. <br />This creates additional need for immediacy. <br />19 <br />May 14, 1996��o . 8 ftr <br />
