Chandler, CONSENT AGENDA <br />County Administrator <br />FROM: James W. Davis, P.E., <br />Public Works Director <br />SUBJECT: Florida Department of Environmental Protection (FDEP) <br />Management Agreement for Certain Sovereignty Submerged <br />Lands in Indian River County, Florida - Boat Club Island <br />REF. LETTER: Cher King, Submerged Lands Section, FDEP to Lea Keller dated May <br />9, 1996 <br />DATE: May 13, 1996 <br />DESCRIPTION AND CONDITIONS <br />The FDEP has prepared the attached Management Agreement for County <br />maintenance of Boat Club Island located in the Indian River north of Grand <br />Harbor. The agreement provides for the County's use of a portion of the island for <br />recreation, but, the County must not conflict with conservation and public <br />navigation projects in the area The State also has the right to enter the property <br />for management activities. The County is responsible for all personal injury and <br />property damage attributable to negligent acts or omissions by the County. <br />Several standard state conditions are listed in the agreement. <br />ALTERNATIVES AND ANALYSIS <br />The alternatives are as follows: <br />Alternative # 1 <br />Approve the agreement and authorize the Chairman's signature. <br />Alternative #2 <br />Deny the approval of the agreement. <br />RECOMMENDATIONS AND FUNDING <br />Staff recommends Alternative # 1 whereby the Chairman is authorized to execute <br />the Agreement on behalf of the County. <br />11 <br />MAY 219 1996 <br />
