improvements or additions as Landlord may deem necessary or desirable. At any time within <br />nine(9) months prior to the expiration of the Term, Landlord shall have the right to display on the <br />exterior of the Demised Premises a customary "For Rent" sign. <br />SECTION 17 <br />Quiet Enjoyment <br />17.01 Landlord's Covenant of Quiet Enjoyment. Landlord covenants that upon Tenant <br />complying with the terms, covenants and conditions of this Lease, Tenant may peaceably and <br />quietly have, hold and enjoy the Leased Premises for the Term without hindrance or interruption <br />by Landlord or by any other person or persons claiming under Landlord. <br />SECTION 18 <br />Holding Over <br />18.01 Rent for Holding Over Period. If Tenant shall continue to occupy the Leased <br />Premises after the end of the Term without Landlord's written consent, then Landlord shall be <br />entitled to recover from Tenant either damages to compensate Landlord for the losses suffered by <br />Landlord as a result of such holding over or, at Landlord's option, compensation for such use and <br />occupancy, at a rate per month equal to one hundred fifty percent (150%) of the Rent in effect for <br />the month immediately preceding such expiration or earlier termination, on the terms and <br />conditions in effect immediately prior thereto. Neither Landlord's demand nor Landlord's receipt <br />of the aforesaid compensation for use and occupancy shall be deemed to provide Tenant with any <br />right to any use, occupancy or possession of the Leased Premises either for the period for which <br />such compensation has been demanded or paid or for any time before or after such period. The <br />provisions of this Section 18.01 shall not be deemed to limit or constitute a waiver of any other <br />rights or remedies of Landlord provided herein or at law. <br />SECTION 19 <br />CONDITION AND RETURN OF PREMISES <br />19.01 Condition of Title and Leased Premises. Tenant agrees that the Leased Premises, the <br />Common Areas and all other parts of the Center, the title to the Leased Premises and the Center, the <br />zoning classification of the Leased Premises and the Center, and the uses of the Leased Premises <br />permitted by applicable Laws have been examined by Tenant; that Tenant accepts the Leased Premises <br />and the Common Areas in there "As -Is", "Where Is" state and condition; that Tenant accepts its rights <br />under this Lease subject to all of the foregoing; and that Landlord has made no representation, <br />covenant or warranty, express or implied, in fact or in law, with respect thereto. <br />19.02 Liability for Return of Leased Premises. At the expiration of the Term, Tenant shall <br />surrender the Leased Premises in the same or better condition as the Leased Premises were in upon <br />delivery of possession to the Tenant under this Lease, reasonable wear and tear and loss by <br />condemnation and insured casualty excepted. <br />SECTION 20 <br />GENERAL <br />20.01 Notices. Any notice provided for in this Lease shall be given by written instrument, <br />personally delivered or sent by United States certified or registered mail, return receipt requested or <br />26 <br />
