1801 27th Street <br />Vero Beach, FL 32960 <br />"Landlord's Address for Pam" shall mean the following address: <br />Indian River County <br />Board of County Commissioners <br />Attention: Finance <br />1801 27th Street <br />Vero Beach, FL 32960 <br />"Landlord's Work" shall mean the work to be completed by Landlord as described in 6.01. <br />"Laws" shall mean all current and future federal, state, and municipal statutes, ordinances, <br />regulations, order, directives, and other requirements of law or common law and of all departments, <br />commissions, boards, and officers of Governmental Authorities (as amended from time to time). <br />"Lease" shall mean this Lease Agreement. <br />"Lease Date" shall mean Upon unconditional approval and mutual execution of lease document <br />(Board of County Commission approval) and delivery of space by Landlord to Tenant. <br />"Leased Premises" shall mean unit 1929 of the Center (indicated as vacant or former Las <br />Palmas on Exhibit A). <br />"Minimum Hours" shall mean the same hours and days that uses similar to the Authorized <br />Use are conducted in the area of the Center, but in any event, no less than the Special Minimum <br />Hours. <br />"Recorded Agreements" shall mean all agreements, covenants, easements, restrictions or <br />other matters now of record or hereafter placed of record. <br />"Rent" shall mean all Minimum Monthly Rental, Additional rent and other sums payable <br />by Tenant under this Lease. <br />"Rent Commencement Date" shall mean the date which is one hundred fifty (150) days <br />the date that Tenant receives all permits, variances and governmental approvals necessary to <br />construct Tenant's store pursuant to Five Guys specifications and operate Tenant's store in the <br />Premises. RE: Notwithstanding the foregoing, rent and all additional charges shall commence not <br />later than the date on which Tenant opens for business to the public. <br />".Special Minimum Hours" shall mean eight (8) hours a day, six (6) days a week. <br />"Taxes" shall mean: <br />(a) All levies, taxes (including payments required to be made in lieu of taxes, <br />including sales tax on rental payments), regular assessments, special assessments, charges, liens, <br />licenses and permit fees, and charges for public utilities, imposed, assessed or charged on or with <br />respect to Landlord or the Leased Premises or the Center by any Governmental Authority or <br />under any Law or Recorded Agreement; and <br />(b) All other charges, imposts or burdens of whatsoever kind and nature, whether or <br />not particularized by name and whether general or special, ordinary or extraordinary, foreseen or <br />
