4. The Contract price may only be changed by a Change Order as authorized by the <br />County Commission. This includes extra work. Authorization of extension of time <br />shall not constitute a waiver of liquidated damages. <br />G. Jnspectipnand Acc,eptqnne o,�tht e or <br />The CONTRACTOR shall assist the COUNTY in performing all tests required to determine <br />the acceptability of the work. The CONTRACTOR shall provide all samples and facilities <br />and work necessary for the testings and inspection. <br />"Select Fill" will be tested for compliance by an independent testing laboratory retained by <br />the County. The CONTRACTOR must notify the County when Soil Replacement is taking <br />places. Limits of excavation must be approved by the County prior to backfilling with "Select <br />Fill". <br />Upon notification by the CONTRACTOR, the Engineer will perform final tests and <br />inspections. Should this reveal defective work those defects must be immediately <br />corrected, after which additional tests and inspection shall be conducted by the Engineer <br />to determine acceptability of the work. Upon acceptance of corrected defective work, this <br />shall constitute final acceptance of the work. <br />K t iMs_ <br />This project is a "Public Work" under Chapter 2.55, Florida Statutes. No merchant's liens <br />may be filed against the OWNER. Any claimant may apply to the OWNER for a copy of <br />this Contract. The claimant shall have a right of action against the CONTRACTOR for the <br />amount due him. Such action shall not involve the OWNER in anv expense. Claims <br />against the CONTRACTOR are subject to timely prior notice to the CONTRACTOR as <br />specified in Florida Statutes Section 255.05. The CONTRACTOR shall insert the following <br />paragraph in all subcontracts hereunder "Notice: Claims Lof labor. materials and supplies <br />are not assessable against -Indian River County and are subiepl to proper nrior_notice to <br />(QQ a to T retCompany-Nam-e)-pursuant to <br />Chaptef, 25 of the Florida 5tatu#es.
