CI <br />E__1 <br />r <br />UTIL (EJCDC.FMT):aa <br />EJCDC <br />STANDARD FORM OF AGREEMENT <br />BETWEEN OWNER AND CONTRACTOR <br />ON THE BASIS OF A STIPULATED PRICE <br />THIS AGREEMENT, dated the 16 day of � in the year <br />199x] by and between Indian River County, a po iticaysubdivision of <br />the State of Florida (hereinafter called OWNER) and Driveways, <br />Inc.(hereinafter called CONTRACTOR). <br />OWNER and CONTRACTOR, in consideration of the mutual covenants <br />hereinafter set forth, agree as follows: <br />Article 1. WORK. <br />CONTRACTOR shall complete all work as specified or indicated in the <br />Contract Documents. The work is generally described as follows: <br />Construction of approximately 36 L.F. of G" DIP, 780 L.F. of 6" PVC <br />and 490 L.F. of 4" PVC water main in the Cherrywood Estates <br />Subdivision from an existing water main located on Cherry Lane (33rd <br />Street), along with fire hydrants and services. Restore the right- <br />of-ways as close as possible to the pre -construction condition or <br />better. Construction consists of, but is not limited to utilities <br />exploration, coordination with any permitting agencies, trenching, <br />dewatering, installation of pipe with fittings and all <br />appurtenances, restrainers and soil compaction, disinfection, <br />testing (includes providing temporary jumper or another approved <br />method for disinfection and .slushing) irrigation repair, as -built <br />drawings and traffic control. The PVC pipe shall be C-900 and the <br />DIP pipe shall be pressure class 350 per Indian River County <br />Utility Standards and Specifications (with metal thickness equal or <br />exceeding the Class 50 for under road). The Contractor shall <br />clearly specify the one used on the bid. Contractor will be <br />provided with a copy of construction plans in AUTOCAD format which <br />includes location reference to state plane coordinates. <br />CONTRACTOR, as an independent contractor and not as an employee, <br />shall furnish, for the sum amount of $40,948.94, all of the <br />necessary labor, material, and equipment to perform the work <br />described above in accordance with the Contract Documents. <br />Article 2. ENGINEER. <br />The project has been designed by Indian River County Utili4ies <br />Department, hereinafter called ENGINEER, and who is to act as <br />OWNER'S rep:.esentative, assume all duties and responsibilities and <br />have the rights and authority assigned to ENGINEER in the Contract <br />Documents in connection with completion of the work in accordance <br />with the Contract Documents. <br />FA --1 <br />
