• <br />C-:1 <br />10. Warranty <br />A. Seller warrants to Buyer that PRS Replacement Products furnished <br />by Seiler shall be free from defects in material, workmanship and <br />title, and shall conform to the PRS Replacement Product's <br />published specifications. With respect to any Vendor Replacement <br />Products (and unreplaced Vendor Products), SELLER GIVES NO <br />WARRANTY, SELLING "AS IS," AND ONLY THE WARRANTY, IF <br />ANY, GIVEN BY THE MANUFACTURER OF THE VENDOR <br />REPLACEMENT PRODUCTS SHALL APPLY. Seller shall have no <br />responsibility or liability for or on account of any Excluded Products <br />or unreplaced PRS Manufactured Products or Vendor Products or <br />any other supporting or related services or systems on which Buyer <br />relies, whether consisting of hardware, software, firmware or <br />otherwise, and Seller does not warrant the performance of the <br />Buyer's System as a whole (as distinguished from the components <br />for which Seller is so warranting). <br />B. For purposes of the warranty set forth in Paragraph 10.A above, the <br />nickel -cadmium batteries supplied by Seller shall be deemed <br />defective if: (1) the battery capacity is less than 80% of rated <br />capacity, or (2) the battery develops leakage. Replacement <br />batteries shall be warranted only for the remaining unexpired <br />portion of the one year warranty period. This warranty becomes <br />void if: (1) the battery has been subjected to any kind of misuse, <br />detrimental exposure, or has been involved in an accident, or <br />(2) the battery is used in equipment or service other than the PRS <br />Replacement Product for which it is specified. <br />C. Seller's obligations set forth in Paragraph 10.D below shall apply <br />only to failures of the PRS Replacement Products to meet the <br />above warranties (except as to title) occurring within the following <br />periods of time from date of delivery to the Buyer, and are <br />conditioned on Buyer's giving written notice to Seller within thirty <br />(30) days of the occurrence of such failure: <br />1. for fuses, and non -rechargeable batteries, operable on <br />arrival only; <br />2. for parts and accessories (except as noted in C.1 above) <br />ninety (90) clays; and <br />3. for all other PRS Replacement Products, one (1) year. <br />t. &,Cmlra.i 5 2KcanuavI.s6Momw Gnat %ersiun Jov Ill <br />,j .,'A9 25 rn <br />
