CI <br />AD <br />9. Coverage, Interference, Year 2000 and Third Party Facilities. <br />Representations concerning the distance at which usable radia signals will <br />be transmitted and received by the Products supplied hereunder (or as to <br />Year 2000 Readiness) shall not be binding upon the Seller unless <br />explicitly and specifically set forth in writing in Seller's Proposal. Radio <br />signals are subject to degradation of service from natural phenomena and <br />other causes beyond the reasonable control of the Seller such as motor <br />ignition and other electrical noises, and interference from other users <br />assigned to the same or adjacent frequencies. The Seller cannot be <br />responsible for interference or disruption of service caused by operation of <br />other radio equipment or by natural phenomena or by motor ignition or <br />other interference over which there is no reasonable control. Such <br />interference and noise may be minimized by addition (at Buyer's expense) <br />of corrective devices adapted for particular locations and installations. <br />Seller may make recommendations as to the use of such devices; <br />however, total freedom from noise and interference cannot be guaranteed. <br />Simiiarly, Seller shall not be responsible for defects or nonperformance <br />with respect to any Vendor Products or Excluded Products in Buyer's <br />System or with respect to any other system or components linked or <br />integrated with or into Buyer's System, whether as to their Year 2000 <br />Readiness or otherwise, even though the effect of such defect or <br />nonperformance is that 'Buyer's System itself (including Seller's Products) <br />are thereby disabled from performing as desired by Buyer. In the event <br />Buyer utilizes facilities or services supplied by others, such as common <br />carrier services and shared services, Seller shall have no responsibility for <br />the availability or adequacy of any such facilities or services including. <br />because of any Year 2000 Readiness problems experienced by any other <br />party or any of its products or vendors or other suppliers. Buyer <br />acknowledges and agrees that Seller shall not be directly or indirectly <br />liable or responsible if Buyer's System is not Year 2000 Heady in time for <br />Year 2000 (or such earlier date as may be applicable to similar date <br />related software or firmware programming problems), subject to the limited <br />warranty in Paragraph 11.
