A Sub - <br />Recipient shall not modify its evaluation factors after proposals have been submitted without re- <br />opening the solicitation. In awarding a contract that will include options, FEMA expects the Sub - <br />Recipient to evaluate proposals for any option quantities or periods contained in the solicitation if <br />it intends to exercise those options after the contract is awarded. <br />The contract shall be awarded to the responsible offeror whose proposal is most advantageous to <br />the program with price and other factors considered. <br />Invitation to Negotiate: If the Sub -Recipient has determined that an ITB or an RFP will not result <br />in the best value, the Sub -Recipient may procure commodities and contractual services using the <br />ITN process. The procurement file shall be documented to support why an ITB and a RFP will not <br />result in best value (287.057(1)(c), Florida Statutes). Contracts that exceed $1 million require a <br />Florida Certified Contract Negotiator. Contracts more than $10 million in any fiscal year, requires <br />a Project Management Professional on the team. <br />Formal competitive solicitation postings or publication on an organization's website shall <br />not be accepted as it discourages true competition. Effective FY2023 such postings shall <br />be via a public forum for example the Florida Administrative Registry, local newspaper, <br />etc. <br />The Division shall pre -approve all scopes of work for projects funded under this agreement. Also, <br />to receive reimbursement from the Division, the Sub -Recipient shall provide the Division with a <br />suspension and debarment form for each vendor that performed work under the <br />agreement. Furthermore, if requested by the Division, the Sub -Recipient shall provide copies of <br />solicitation documents including responses and justification of vendor selection. <br />Contracts may include: <br />State Term Contract: A State Term Contract is a contract that is competitively procured by the <br />Division of State Purchasing for selected products and services for use by agencies and eligible <br />users. Florida agencies and eligible users may use a request for quote to obtain written pricing or <br />services information from a state term contact vendor for commodities or contractual services <br />available on a state term contract from that vendor. Use of state term contracts is mandatory for <br />Florida agencies in accordance with section 287.056, Florida Statutes. <br />Alternate Contract Source: An Alternate Contract Source is a contract let by a federal, state, <br />or local government that has been approved by the Department of Management Services, based <br />on a determination that the contract is cost-effective and in the best interest of the state, for use <br />by one or all Florida agencies for purchases, without the requirement of competitive procurement. <br />Alternate contract sources are authorized by subsection 287.042(16), Florida Statutes, as <br />implemented by Rule 60A-1.045, Florida Administrative Code. <br />General Services Administration Schedules: The General Services Administration (GSA) is an <br />independent agency of the United States Government. States, tribes, and local governments, and <br />any instrumentality thereof (such as local education agencies or institutions of higher education) <br />may participate in the GSA Cooperative Purchasing Program.). Refer to the appropriate GSA <br />Schedule for additional requirements. <br />N. Piggybacking <br />The practice of procurement by one agency using the agreement of another agency is called <br />piggybacking. The ability to piggyback onto an existing contract is not unlimited. The Sub - <br />Recipient's written procurement policy shall be submitted to the Division and shall allow for <br />piggybacking. The existing contract shall contain language or other legal authority authorizing <br />third parties to make purchases from the contract with the vendor's consent. The terms and <br />conditions of the new contract, including the Scope of Work, shall be substantially the same as <br />those of the existing contract and approved by the Division.
