ARTICLE $ - AVAILABILITY OF LAND r; PHYSICAL CONDITIONS; REFERENCE POINTS <br />Availability of Lands: <br />4.1 OWNER shall furnish, as indicated in the Contract Documents, the lands upon which the <br />Work is to be performed, rights-of-way and easements for access thereto, and such Cather <br />lands which are designated for the use of CONTRACTOR. Easements for permanent <br />structures or pan-nanent changes in existing facilities will be obtained and paid for by <br />OWNER, unless otherwise provided in the Contract 'Documents. If CONTRACTOR <br />believes that any daisy in OWNER's furnishing these lands, right-of-way or easements <br />entitles CONTRACTOR to an extension of Uie Contract Time, CONTRACTOR may make <br />a claim therefor as provided in article 12. CONTRACTOR shall provide for all additional <br />lands and access thereto that may be required for temporary construction facilities or <br />storage of materials and equipment. <br />Physical Conditions/Available Reports: <br />4.2 Exploration and Reports; Reference is made in the Supplementary Conditions for <br />identification of those reports of exploration and tests of subsurface conditions at the site <br />that have been utilized by ENGINEER in preparation of the Contract Documents. Such <br />reports are not guaranteed as to accuracy or completeness and are not part of the <br />Contract Documents, <br />4.3 Unforeseen Conditions: CONTRACTOR shall promptly notify OWNER and ENGINEER in <br />writing of any subsurface or latent physical conditions at the site or in an existing structure <br />differing materially from those indicated or referred to in the Contract Documents. <br />ENGINEER will promptly review those conditions and advise OWNER in writing if further <br />investigation or tests are necessary. <br />a <br />Promptly thereafter, OWNER shall obtain the necessary additional investigations and tests <br />and furnish copies to ENGINEER and CONTRACTOR. If ENGINEER finds that the results <br />F of such investigations or tests indicate that there are subsurface or latent physical <br />conditions which differ materially from those intended in the Contract Documents, and <br />G; which could not reasonably have been anticipated by CONTRACTOR, a Change Order <br />shall be issued incorporating the necessary revisions. <br />Physical Conditions - Underground Facilities: <br />4.4 Shown or Indicated: The information and data shown or indicated in the Contract <br />r Documents with respect to existing Underground Facilities at or contiguous to the site are <br />based on information and data furnished to OWNER or ENGINEER by the owners of soinh <br />iindergrouna Facilities or by others. Unless it is otherwise expressly provided in the <br />Supplementary Conditions: <br />4.4.1 OWNER and ENGINEER shalt not be responsible for the accuracy or <br />completeness of any such information or data; and <br />4.4.2 CONTRACTOR shall have full responsibility for reviewing and checking all such <br />information and data, for locating all Underground Facilities shown or indicated in <br />the Contract Documents, for coordination of the Work with the owners of such <br />Underground Facilities during construction, for the safety and protection thereof as <br />GFNFRAI.
