county is in an emergency situation as far as erosion is concerned; <br />however, these property owners could have gone to DEP for permits <br />previously so that they would be prepared to start construction as <br />soon as turtle season is over. She thought they have created their <br />own emergency situation. She would have no hesitancy in issuing <br />the permit in a storm situation but hesitates at this point in time <br />because they are not being threatened with a storm. <br />Chester Clem, attorney for the applicants, stated that <br />legislators had addressed the emergency situation in 1995 and <br />permitted the County to issue these emergency permits. The County <br />has granted a permit for the first 8 houses out of 21 in the <br />Summerplace erosion area. All they are asking is that the County <br />go to the end of the erosion emergency area, no further. Mr. Clem <br />handed out several photographs of homes along the beachfront and <br />said that if Hurricane Bertha had hit, he did not know what we <br />would be doing. The applicants are prepared to go to DEP with a <br />proposal to complete the project after the end of turtle season and <br />are prepared to make a condition of their request that they will <br />move immediately to get DEP involved. The applicants will join in <br />an application with the first 8 properties. They recognize that <br />DEP can tell them that the construction was done on an emergency <br />basis and will have to be removed but these people are desperate <br />and are willing to spend $30,000 to $40,000 just to see what <br />happens. <br />Commissioner Eggert had understood that Mr. Glynn and his <br />attorney had already filed for the DEP permit, and Mr. Clem advised <br />that the application has not yet been filed. <br />Dan Hersh, of 956 Doubloon, stated that the applicants intend <br />to file jointly with Bill Glynn for the DEP permits. Mr. Hersh's <br />property has experienced a 21 foot loss in beach during the last <br />year and the dune continues to erode. Coastal Tech has been hired <br />to do the measurements. The applicants recognize that DEP may not <br />grant approval of the project. Mr. Hersh is also speaking for <br />applicant Dick Simpson who is ill and for Dr. Dirk Parvus. <br />County Coastal Engineer Jeff Tabar stated that no one is <br />denying the situation at the north beach but felt the Commissioners <br />need to carefully coordinate projects with DEP. The major goal is <br />to restore the beaches and the situation with the seawalls is to <br />allow for protection in emergency situations. Mr. Tabar was <br />concerned as well about the emergency issue and felt if there is no <br />present emergency, the Board should not allow the permit. <br />Chairman Adams stated that she felt comfortable supporting the <br />application to DEP but not comfortable with jeopardizing the thin <br />JULY 16, 1996 37 BOOK 98 FA,c: 567 <br />
