BOOK 98 f� E 568 <br />line of trust established with DEP by issuing an emergency permit <br />when there is no emergency situation. <br />Chester Clem assured the Board that the applicant will work <br />with DEP but urged the Board to grant the emergency permit. <br />Chairman Adams believed Mr. Clem would surely have an <br />opportunity to get the emergency permit but reminded the applicants <br />that they could have already been talking with DEP had they chosen <br />to. <br />Chester Clem felt that since the County had granted the permit <br />for the first 8 units, it is also an emergency for the next 13 <br />houses. It is the same project and the same emergency. <br />Deputy County Attorney Collins remarked that the statute on <br />rigid coastal armoring assigns much more responsibility to the <br />State than to the County. The County can only issue the permits if <br />the State has not and the Board finds erosion threatened as a <br />result of a storm. The Board must consider any impact on adjacent <br />properties. There is nothing to preclude Mr. Clem's clients from <br />applying to the State but if the County applies to the State, the <br />County would face an order to remove the structures at great <br />expense. <br />Chester Clem stated that the applicants will go to DEP on an <br />emergency basis but it takes at least 18 months. The reality of <br />the situation is that the applicants need to get on the train with <br />Mr. Glynn's group. <br />Charlie Cangianelli, of Cangianelli Construction, stated that <br />construction materials take 30 to 60 days to arrive and they need <br />to go ahead and order them. <br />Commissioner Macht asked for a definition of "emergency", and <br />Deputy County Attorney Collins advised the statute contains no <br />definition of emergency. <br />Commissioner Macht felt we have no reason to think the <br />situation will resolve itself and the Board has already granted the <br />same relief to the adjacent property owners. The applicants have <br />the same situation and the same right to protect their homes. <br />Commissioner Bird did not see any difference in the emergency <br />status. <br />Commissioner Tippin also could not see that it is a different <br />situation. <br />Commissioner Eggert agreed there is very definitely an <br />emergency there and the condition has been made worse because the <br />first section of the wall is in. She had no problem with issuing <br />an emergency permit. <br />JULY 169 1996 38 <br />
