B00K 98 F JE672 <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, to adopt Resolutions 96-77 and <br />96-78, to provide for the paving and drainage <br />improvements to 26th Street (Walker Ave.) West of <br />66th Avenue to Village Green, Phase II, and set <br />public hearing date for 9:05 a.m., Tuesday, August <br />13, 1996. <br />Under discussion, Public Works Director Jim Davis wanted the <br />Board to be aware that one parcel is not included in this price <br />because we have not been able to obtain right-of-way. He asked <br />that the Board not include the parcel in the assessment but rather <br />go to condemnation proceedings and pay fair market value. <br />Deputy County Attorney Will Collins explained that trying to <br />acquire this property became very complicated because the owners <br />have declared bankruptcy. Adoption of Resolution 96-78 would set <br />the public hearing date for the paving and drainage improvement <br />project. In the meantime, we can use our powers to acquire the <br />right-of-way. <br />THE CHAIRMAN CALLED FOR THE QUESTION.
