40 <br />40 <br />40 <br />SUPPLEMENTARY CONDITIONS TO GENERAL CONDITIONS <br />I� <br />V A. Intrrad mt on <br />These Supplementary Conditions amend or supplement the General Conditions (GC) of the <br />Construction Contract and other provisions of the Contract Documents as indicated below. All <br />provisions which arc not so amended or supplemented remain in full force and effect. <br />t ti <br />l 1. No forfeiture due to delay shall be made because of any delays in the completion of the <br />I work due to unforeseeable causes beyond the control and without the fault or negligence of <br />the CONTRACTOR (including but not restricted to Acts ofGod or of the public enemy, acts <br />t of the goverment, acts of the OWNER, or acts of another CONTRACTOR in the <br />perfonnance of a contract with the OWNER, fires, Floods, epidemics, quarantine <br />restrictions, strikes, freight embargoes and unusually severe weather or delays of <br />subcontractors due to such causes or delays caused by the failure of the OWNER or the <br />t owner of a utility to provide for removal or relocation of existing utility facilities). Any <br />such delays shall not entitle the CON'rP NCTOR to any additional compensation. The sole <br />remedy of the CONTRACTOR shall be an extension of time obtained in accordance with <br />this section. <br />2. The CONTRACTOR shall, within Five days from the beginning of any such delay, notify <br />1 the OWNER in writing of the cause of delay, whereupon the OWNER shall ascertain the <br />t facts and eluent of the delay and extend the time for completing the work if, in his <br />judgment, the findings of fact justify such an extension, and his findings of facts thereon <br />shall be final and conclusive. <br />1411111111111111111 u <br />1, As set forth in paragraph 6.15 of the GC, the OWNER has obtained the following permits: <br />I a. IRC - Land Clearing, and Tree Removal <br />I b. IRCDUS - Utility Construction <br />C. SJRWMD - Management and Storage of Surface Waters <br />l d. FDEp - Wastewater and Water Distribution <br />C. FDOT- Utility <br />I f. ACOE - Navigable Waters <br />2. The CONTRACJOR shall obtain and pay for all other required permits and licenses. 'I"he <br />I CONTRACTOR shall provide copies of these permits to the OWNER and Engineer and <br />I shall compiy with all conditions contained in the permits at no extra cost to the OWNEK. <br />3. The CONTRACTOR shall be familiar with all permit requirements during construction and <br />shall be responsible for complying, with these requirements. The cost of this effort shall be <br />included in the pay item which the work is most closely associated with. <br />4, If dcwamirig is rcquired, the CON I KAC l OR shall coordinate with the St. Johns Rivei <br />Water Management District regarding the applicable rules and regulations. If a dewatering; <br />permit is required, the contractor shall prepare an applicatiolt to the oisinct and pay any ice. <br />D.
