FWC Agreement No. #23230 <br />A. Disclosure of Interested State Employees. <br />This Agreement is subject to Chapter 112, F.S. Recipient shall provide the name of any officer, director, <br />employee, or other agent who is affiliated with this project and an employee of the State of Florida. If the <br />Agreement includes a Federal award, then the Agreement is also subject to Section 200.112, OMB Uniform <br />Guidance (2 CFR 200). Recipient must disclose, in writing, any potential conflict of interest to the <br />Commission in accordance with applicable Federal awarding agency policy. <br />B. Convicted Vendors. <br />The Recipient hereby certifies that neither it, nor any person or affiliate of Recipient, has been convicted of <br />a Public Entity Crime as defined in section 287.133, F.S., nor placed on the convicted vendor list. Recipient <br />shall have a continuing obligation to disclose, to the Commission, in writing, if it, its principals, recipient, <br />subrecipient, contractor, or subcontractor, are on the convicted vendors list maintained by the Florida <br />Department of Management Services pursuant to Section 287.133(3)(d), F.S. <br />Convicted Vendor List. Pursuant to Subsection 287.133(2)(a), F.S., a person or affiliate who has <br />been placed on the convicted vendor list following a conviction for a public entity crime may not be <br />awarded or perform work as a Recipient, supplier, subcontractor or consultant under a contract with <br />any public entity and may not transact business with any public entity in excess of the threshold <br />amount provided in Section 287.017, F.S., for Category Two for a period of thirty-six (36) months <br />from the date of being placed on the convicted vendor list. Notice of Conviction of Public Entity Crime. Any person must notify the Department of <br />Management Services and the Commission, in writing, within thirty (30) days after conviction of a <br />public entity crime applicable to that person or an affiliate of that person as defined in Section <br />287.133, F.S. <br />iii. Vendors on Scrutinized Companies List. The Recipient certifies that it and any of its affiliates are <br />not scrutinized companies as identified in Section 287.135, F.S. In addition, the Recipient agrees to <br />observe the requirements of Section 287.135, F.S., for applicable sub -agreements entered into for <br />the performance of work under this Agreement. Pursuant to Section 287.135, F.S., the Commission <br />may immediately terminate this Agreement for cause if the Recipient, its affiliates, or its <br />subcontractors are found to have submitted a false certification; or if the Recipient, its affiliates, or <br />its subcontractors are placed on any applicable scrutinized companies list or engaged in prohibited <br />contracting activity during the term of the Agreement. As provided in Subsection 287.135(8), F.S., <br />if federal law ceases to authorize these contracting prohibitions, then they shall become inoperative. <br />C. Discriminatory Vendors. <br />The Recipient shall disclose to the Commission, in writing, if they, their subrecipient, contractor, or <br />subcontractor, are on the Discriminatory Vendor List maintained by the Florida Department of <br />Management Services pursuant to Section 287.134(3)(d), F.S. "An entity or affiliate who has been placed <br />on the discriminatory vendor list may not submit a bid, proposal, or reply on a contract to provide any <br />goods or services to a public entity; may not submit a bid, proposal, or reply on a contract with a public <br />entity for the construction or repair of a public building or public work; may not submit bids, proposals, or <br />replies on leases of real property to a public entity; may not be awarded or perform work as a contractor, <br />Recipient/Subrecipient Agreement Last Revised: 3.20.2023 Page 13 of 29 <br />
