ATTACHMENT C <br />SUB -RECIPIENT vs. VENDOR DETERMINATION <br />FOR CONTRACTUAL SERVICES FUNDED (wholly or in part) BY FEDERAL AWARDS TO FWC <br />Contractor/Grantee: Indian River County <br />FWC Project Title: Indian River County Shooting Range Expansion Project <br />Federal Agency/Program: U.S. Fish and Wildlife Service/ Hunter Education <br />Federal Agency Award Number: TBD <br />CFDA No.: 15.611 FLAIR Grant Number: TBD <br />Based on Federal guidelines in The Code of Federal Regulations, 2 CFR 200 <br />(a) General Federal funds expended as a sub -recipient would be subject to audit under the requirements <br />of Code of Federal Regulations 2 CFR 200 Subpart F. Payment received by a vendor for goods and services <br />provided would not be considered Federal awards and would not be subject to audit. The guidance in <br />sections (b) and (c) below should be considered in determining whether payments constitute a Federal <br />award to a sub -recipient or constitute payment to a vendor for goods and services. <br />(b) Characteristics of a sub -recipient are when the organization receiving the contract (check all <br />that apply): <br />121 (1) determines who is eligible to receive specific Federal financial assistance; <br />El (2) has its performance measured against whether the objectives of the Federal program <br />funding the services are met; <br />El (3) has responsibility for programmatic decision-making; <br />O (4) has responsibility for adherence to applicable Federal program compliance requirements; <br />❑ (5) uses the Federal funds to carry out a program of the organization instead of providing goods <br />or services for a program of the pass-through entity. <br />Some additional characteristics (in reference to research projects) of a sub -recipient <br />relationship include, but are not limited to, when: <br />❑ (6) substantive, programmatic work or an important or significant portion of a research program or <br />project is being undertaken by the other entity; <br />❑ (7) the other entity participates in a creative way in designing and/or conducting the research; <br />❑ (8) a principal investigator has been identified at the entity and functions as a "Co -Investigator"; <br />❑ (9) there is an expectation that the entity will retain ownership rights in potentially patentable or <br />copyrightable technology or product that it produces in the course of fulfilling its scope of work; <br />❑ (10) publications may be created or co-authored at the entity; <br />❑ (11) the entity provides cost sharing or matching funds for which it is not reimbursed by pass- <br />through entity. <br />(c) Characteristics of a vendor are when the organization receiving the contract (check all that <br />apply): <br />❑ (1) provides the goods and services within normal business operations; <br />❑ (2) provides similar goods and services to many different purchasers; <br />11 (3) operates in a competitive environment; <br />
