FWC Agreement No. Enter CFDA Number(s) <br />transport, cause to be transported, carry or cause to be carried by any means <br />whatsoever, receive for shipment, transport of carriage, or export, at any time, or <br />in any manner, any migratory bird, or any part, nest, or egg of such bird. <br />E. Endangered Species Act, 16 U.S.C. 1531, et seq. <br />The Act provides a program for the conservation of threatened and endangered <br />plants and animals and the habitat in which they are found. The Act also prohibits <br />any action that cause a "taking" of any listed species of endangered fish or <br />wildlife. Also, generally prohibited are the import, export, interstate, and foreign <br />commerce of listed species. <br />Section 24. FEDERAL FUNDS. <br />This Agreement relies on federal funds, therefore, the following terms and conditions <br />apply: <br />A. Prior Approval to Expend Federal Funds to Federal Agency or Employee. <br />It is understood and agreed that the Recipient is not authorized to expend any <br />federal funds under this Agreement to a federal agency or employee without the <br />prior written approval of the awarding federal agency. <br />B. Equal Employment Opportunity. <br />Executive Order 11246 of September 24, 1965, entitled "Equal Employment <br />Opportunity," as amended by Executive Order 11375 of October 13, 1967, and as <br />supplemented in Department of Labor regulations (41 CFR Part 60-1.4). 41 CFR <br />Part 60-1.4 is hereby incorporated by reference. <br />C. Davis -Bacon Act. <br />Unless exempt, the Davis -Bacon Act, 40 U.S.C. 3141-3148, as supplemented by <br />Department of Labor regulations at 29 CFR Part 5, is applicable to contractors <br />and subcontractors performing on federally funded or assisted contracts in <br />excess of $2,000.00 for the construction, alteration, or repair (including painting <br />and decorating) of public buildings or public works. Under this Act, contractors <br />and subcontractors must pay their laborers and mechanics employed under the <br />Agreement no less than the locally prevailing wages and fringe benefits for <br />corresponding work on similar projects in the area.
