r, <br />BOOK 98 mc -1943 <br />MOTION WAS MADE by Commissioner Macht, SECONDED BY <br />Commissioner Bird, to table the matter and have <br />staff put it on the LAAC agenda for tomorrow as an <br />emergency item. <br />Mr. DeBlois asked if staff should bring the matter back to the <br />Board next Tuesday, but Commissioner Bird thouccht it should be <br />brought back when we get the final form of the lease. <br />Mr. Hardee thought it reasonable that the Board see the lease <br />before closing. <br />Chairman Adams suggested it be brought back in two weeks and <br />there was a consensus. <br />THE CHAIRMAN CALLED THE QUESTION and the motion <br />carried unanimously. <br />58TH AVENUE & 26TH STREET R -O -W ACQUISITION - PARCEL #112 <br />- DODGERTOWN. INC. <br />The Board reviewed a Memorandum of August 19, 1996: <br />TO: James E. Chandler <br />County Administrator <br />THROUGH: James W. Davis, P.E <br />Public Works Director <br />FROM: Donald G. Finney, SRA <br />County Right -of -Way Agent <br />DATE: August 19, 1996 <br />SUBJECT: 58th Avenue and 26th Street Right -of -Way Acquisition <br />Parcel #112, Dodgertown, Inc. <br />Thirty -Five feet of additional right-of-way is required on 58th Avenue and fifty feet of <br />additional right-of-way on 26th Street for the paving improvement project from Route 60 <br />to north of 26th Street. <br />The County offered to purchase the right-of-wW parcel for $55,000.00 which is $22,000.00 <br />Per acre. The Dodger Organization executed a contract to deed the 2% acre right-of-way <br />to the County for $65,000.00 which is $26,000.00 per acre. <br />The County has a recent appraisal of the subject property at $22,000.00 per acre. The <br />property owner consulted with his appraiser and counter offered at $30,000.00 per acre. <br />Both parties agreed to a mid point settlement in lieu of the property owner obtaining his <br />appraisal at $30,000.00 per acre and in lieu of extending the time to acquire the property, <br />consequently there are no additional appraisal fees or attorney fees. <br />RECOMMENDATIONS AND FUNDING <br />Staff requests the Board of County Commissioners approve the $65,000.00 purchase <br />contract and authorize the Chairman to execute the contract. <br />Funding to be from Local Option Sales Tax Account No. 315-214-541-066.12. <br />August 27, 1996 <br />42 <br />
