Guerra, AICP, LEED-AP, CPD <br />Chief, Code Enforcement Division <br />DATE: March 19, 2024 <br />RE: Request for Release of a Drainage Easement at 5298 Old Dixie Highway <br />It is requested that the Board of County Commissioners formally consider the following information at its <br />regular meeting of April 9, 2024. <br />DESCRIPTION AND CONDITIONS <br />Vero Investment 53 LLC, owner of the subject property, has requested the release of a drainage easement. <br />The easement that is requested for release is located on Lot 1 of the 53' Street / US -1 Commercial <br />Subdivision Replat of Lots 2 & 3 (see attached map). <br />The purpose of the drainage easement release request is to accommodate proposed site improvements on <br />the subject property. <br />ANALYSIS <br />Portions of this same drainage easement were previously released by the Board of County Commissioners on <br />Lots 2 and 3 in 2020. The request has been reviewed by the Indian River County Public Works Department and <br />the Indian River County Surveyor. None of the reviewing agencies expressed an objection to the requested <br />release of the drainage easement. Therefore, it is Staffs position that the requested drainage easement release <br />would have no adverse impact on drainage for subject property or to other properties. <br />RECOMMENDATION <br />Staff recommends that the Board, through adoption of the attached Resolution, approve the release of the <br />drainage easement at 5298 Old Dixie Highway. <br />ATTACHMENTS: <br />1.
