v <br />s <br />401 not constitute a waiver of liquidated damages. <br />G. jnspcetion and Accc ptan ,e of the Work <br />The CONTRACTOR shall assist the COUNTY in performing all tests required to determine the <br />acceptability of the work. The CONTRACTOR shall provide all samples and facilities and work <br />necessary for the testings and inspection. <br />"Select Fill" will be tested for compliance by an independent testing laboratory retained by the <br />COUNTY. The CONTRACTOR must notify the COUNTY when Soil Replacement is taking place. <br />Limits of excavation must be approved by the COUNTY prior to backfilling with "Select Fill". <br />Upon notification by the CONTRACTOR, the ENGINEER will perform final tests and inspections. <br />Should this reveal defective work those defects must be immediately corrected, after which <br />additional tests and inspection shall be conducted by the ENGINEER to determine acceptability of <br />the work. Upon acceptance of corrected defective work, this shall constitute final acceptance of the <br />work. <br />H. Lidos <br />This project is a "Public Work" under Chapter 255, Florida Statutes. No merchant's liens may be <br />filed against the OWNER. Any claimant may apply to the OWNER for a copy of this Contract. The <br />claimant shall have a right of action against the CONTRACTOR for the amount due him. Such <br />action shall not involve the OWNER in any expense. Claims against the CONTRACTOR are <br />subject to timely prior notice to the CONTRACTOR as specified in Florida Statutes Section 255.05. <br />The CONTRACTOR shall insert the following paragraph in all subcontracts hereunder "Notice; <br />M71—mm + 04 IP . + M 1 1c K!VA <br />in eversttb-ehcnntract hereunder." The payment due under the Contract shall be paid by the <br />OWNER to the CONTRACTOR only after the CONTRACTOR has furnished the OWNER with an <br />affidavit stating that all persons, firms or corporations who are defined in Section 713.0 1, Florida <br />Statutes, who have furnished labor or materials, employed directly or indirectly in the work, have <br />been paid in full. <br />,Erotcction of Public <br />Where there are telephone, telegraph, light, or power poles, water main, conduits, pipe, or <br />drains; or other construction either public or private; in or on the streets or alleys; the work <br />shall be so conducted that no interruption or delay will be caused in the operation or use of <br />the some, Proper written notice shall be given and all the facilities afforded the owners of <br />such construction encountered or likely to he encountered, as will enable them to preserve <br />the same from injury. <br />2. The CONTRACTOR will not be permitted to interfere with public travel and convenience <br />by grading or tearing up streets indiscriminately, but the work of conducting the various <br />items of this Contract shall proceed in an orderly, systematic: and progressive maturer. <br />Work under this contract will be paid on a lump sum or unit price basis as outlined on the <br />Sid Form for the quantity of work installed. <br />SUPPLEMENTARY CONDITIONS <br />sc - 3 <br />
