Indian River County Solid Waste Disposal District <br />Solid Waste and Recyclables Franchise Agreement <br />ARTICLE 3. EXCLUSIVE AND NON-EXCLUSIVE SERVICES <br />3.1. Exclusive Services <br />The Franchisee is herein granted the exclusive right to provide the following collection services: <br />a. Residential Collection Service and Commercial Collection Service in the Solid Waste Franchise Area. <br />b. Residential Recyclables Collection Service in the Recycling Franchise Area. <br />c. Commercial Recycling Services at Indian River County Government Buildings and Facilities. <br />Franchisee shall transport and deliver all collected materials to Designated Sites as specified herein. <br />3.2. Non -Exclusive Services <br />3.2.1. The Franchisee shall provide collection of Recyclables from Commercial Properties upon request and <br />as required in Article 7.3 of this Agreement. However, the provision of this service is not exclusive to the <br />Franchisee. <br />3.2.2. Per the County's Code of Ordinances Section 204.08, the following types of materials are exempt from <br />the provisions of the Agreement and may be collected and disposed of by the owner or occupant of any <br />premises, or the owner's or occupant's representative, at the owner's or occupant's expense. Descriptions are <br />derived from the County Code and include minor additional descriptors to provide clarity to the Franchisee: <br />a. Land clearing debris. <br />b. Construction and Demolition Debris, including residential Construction and Demolition Debris. <br />c. Trash and debris associated with farming operations. <br />d. Extraordinary, Hazardous, Biomedical, and radiological waste. <br />e. Wrecked, scrapped, ruined, or dismantled motor vehicles, or motor vehicle parts, including <br />used oil, tires, and batteries. <br />f. Recyclable Materials generated by Commercial Customers, provided the materials are <br />subjected to a recycling process. <br />g. Residential Solid Waste generated in the areas of Indian River County lying outside the SWDD <br />boundaries of the Solid Waste Franchise Area. <br />h. Solid Waste, and Yard Waste generated in the incorporated areas (i.e., municipalities) of Indian <br />River County which are not included within the Solid Waste Franchise Area, as defined in <br />Exhibit 2, and as applicable. <br />i. Sludge. <br />j. Liquid, semisolid, or contained gaseous material resulting from domestic, industrial, <br />commercial, mining, agricultural, or governmental operations. <br />3.2.3. Residential Customers may self -haul Solid Waste, Recyclable Materials, and/or Yard Waste to permitted <br />or appropriate disposal or processing facilities if they so choose. Residential and Commercial Customers may <br />also utilize a Private Hauler for the removal of Bulk Waste and White Goods from a person's premises that must <br />also include the transportation of the material from the site of generation to a Designated Facility. <br />3.2.4. Franchisee is not granted or guaranteed the right to collect Disaster Debris resulting from natural or <br />human induced emergency that is officially declared a Disaster as defined herein. The County has a Disaster <br />Debris contract for such services. Should SWDD request Franchisee assistance for non -emergency storm debris, <br />compensation will be negotiated at time of request. <br />3.2.5. SWDD reserves the right to exclude the collection of other materials from this Agreement in the future <br />for the purposes of increasing recycling and helping the County in their waste reduction and material diversion <br />efforts. <br />11 <br />
