Indian River County Solid Waste Disposal District <br />Solid Waste and Recyclables Franchise Agreement <br />13.3.2. All Collection vehicles substantially dedicated to the Agreement shall prominently and permanently <br />display, on both sides of the vehicle body, at all times and in letters at least six inches high, information approved <br />and authorized by the Contract Manager and the type of material (Solid Waste, Yard Trash, or Recyclable <br />Materials) being collected. <br />13.3.3. If requested by the Contract Manager, Franchisee shall display the SWDD theme and logo on the sides <br />and rear of every vehicle newly put into service in the County to collect Solid Waste, Recyclables, Yard Trash and <br />Bulk Trash pursuant to this Agreement. The signs/graphic shall be appropriately sized, as mutually agreed. <br />SWDD will provide approved artwork for the Collection vehicles. <br />13.4. Maintenance and Cleanine <br />13.4.1. Franchisee shall monitor, maintain, and repair its collection vehicles and equipment, at a minimum, in <br />compliance with the manufacturer's recommendations and Applicable Law. Oil/hydraulic systems and <br />waterproof seals/enclosures shall be kept in good condition at all times to prevent spills and leaks. <br />13.4.2. Franchisee shall keep all equipment in good repair and shall monitor all vehicles to prevent fuel and <br />lubricant leaks or spills. All spills discovered shall be cleaned up immediately. <br />13.4.3. Franchisee shall keep all equipment in sanitary, clean condition at all times. Franchisee shall wash <br />Collection vehicles thoroughly on the outside and sanitize them with a suitable disinfectant and deodorant a <br />minimum of once per week (or more frequently if necessary). <br />13.4.4. SWDD retains the right, at its discretion, to require a vehicle be taken out of service for habitual <br />maintenance issues. These include, but are not limited to, habitual spills, leaks, repeated breakdowns, and other <br />issues that impact the level of service required under contractual terms. <br />13.5. Right to Inspect Vehicles <br />13.5.1. Franchisee shall permit the Solid Waste Management Department to inspect the vehicles, equipment, <br />licenses, and registrations at any reasonable time. Except for extraordinary circumstances, as determined by <br />the Contract Manager, all vehicles and equipment utilized to provide service under the Agreement shall be <br />empty and devoid of all Solid Wastes prior to the commencement of daily Collection Service. The County <br />reserves the right to inspect each vehicle, every day, prior to its use in the County. <br />ARTICLE 14. COLLECTION PROCEDURES <br />14.1. General Collection Procedures <br />14.1.1. Franchisee shall thoroughly empty Collection Containers and return them with lids closed in an upright <br />position to their original location, unless conditions warrant otherwise, as approved by the Contract Manager. <br />The Franchisee shall require their driver(s) to return the Collection Containers manually with the lid closed to <br />the upright position and in their original locations if the driver(s) is responsible for knocking the Collection Cart <br />down. <br />14.1.2. Franchisee shall provide all Residential Collection Services with minimal noise and disturbance. <br />14.1.3. All collection vehicles shall remain on the right-hand side of the road when providing Residential <br />Collection Service and at no time shall collection personnel cross to the left-hand side of the road to retrieve <br />containers, Roll Carts or materials that have been set out for collection. <br />14.1.4. Franchisee shall handle Collection Containers in a manner to prevent damage. <br />14.1.5. Franchisee's employees shall not trespass on private property, even to access an adjacent property, <br />unless the resident or owner of said property has given permission in writing to Franchisee and SWDD prior to <br />accessing the property. <br />14.1.6. Franchisee's employees shall take care to prevent damage to public and private property and roadways, <br />including flowers, shrubs, and other plantings. <br />25 <br />
