Indian River County Solid Waste Disposal District <br />Solid Waste and Recyclables Franchise Agreement <br />15.2. Operations Manager <br />15.2.1. Franchisee shall appoint an individual who is one hundred percent (100%) dedicated to overseeing and <br />implementing the Collection Services provided pursuant to the Agreement, ensuring compliance with the terms <br />of the Agreement, and with the authority to make significant decisions regarding Collection Services <br />("Operations Manager'). All route managers shall report to the Operations Manager. <br />15.2.2. Prior to appointment, Franchisee shall submit the qualifications of any proposed Operations Manager <br />to SWDD for approval. The Operations Manager shall have at least ten (10) years of prior managerial experience <br />with solid waste collections of this nature and size. SWDD reserves the right not to approve the proposed <br />Operations Manager if the individual is deemed not to be qualified based on SWDD's sole judgment. Franchisee <br />shall obtain SWDD approval prior to appointment of any Operations Manager. <br />15.2.3. The Operations Manager shall be the primary point of official contact on behalf of Franchisee for all <br />technical and administrative matters pertaining to the Agreement. At all times during the term of the <br />Agreement, SWDD shall have access to the Operations Manager. Any communications or writings that may be <br />required under the Agreement to be given to Franchisee shall be delivered to the Operations Manager. Such <br />communications or writings shall be considered as having been received by Franchisee when delivered to the <br />Operations Manager. <br />15.2.4. The Operations Manager shall have direct access to Franchisee's entire management organization for <br />resolving problems beyond the Operations Manager's authority. <br />15.3. Collection Supervisor <br />15.3.1. Franchisee shall designate one or more collection supervisor(s) ("Collection Supervisor"), who shall <br />oversee provision of the Collection Services according to the terms of the Agreement. SWDD may require <br />Collection Supervisors for up to four lines of business (Residential Solid Waste, Residential Yard Waste, <br />Residential Recycling, and Commercial/Roll-off). The Collection Supervisors shall be readily available by two- <br />way radio or cellular telephone at least between 6:00 a.m. and 6:00 p.m. Monday through Friday, and Saturdays <br />during Holiday weeks. At least one Collection Supervisor shall be available by radio or cellular telephone every <br />Saturday between 6:00 a.m. and 6:00 p.m. <br />15.4. Dedicated Personnel <br />15.4.1. The Operations Manager, Collection Supervisors, general administrative manager, and other key <br />personnel assigned by Franchisee to the Agreement shall be dedicated solely to the Agreement. No internal <br />reorganization by Franchisee shall remove Franchisee's obligation to meet this requirement. <br />15.5. Employee Conduct <br />15.5.1. All Franchisee personnel must always maintain a courteous and respectful attitude toward the public. <br />Franchisee shall direct its employees to always avoid loud and/or profane language or gestures during the <br />performance of duties. <br />15.6. Employee Appearance and Identification <br />15.6.1. Franchisee must furnish each Collection employee with a uniform that identifies the employee and <br />Franchisee and complies with Franchisee's Safety Program. SWDD reserves the right to approve the identifiers <br />or identification furnished by Franchisee. <br />15.6.2. Employees shall wear identification at all times while on duty. <br />15.7. Employee Training and Licenses <br />15.7.1. All of Franchisee's employees shall be qualified and appropriately trained for the tasks assigned to <br />them. Franchisee shall provide refresher courses and additional training to its employees, as needed, to ensure <br />compliance with the requirements of this Agreement and all Applicable Law. The SWDD has the right to review <br />Franchisee's training records. <br />29 <br />
